Please give me some advice on CR1

Hi all! It seems to me that K1 is running at about 8 months a CSC. That is until NOA2 I assume...then you need NVC and then your respective Embassy..which in my case is running 2-3 mths to get an appointment.(Montreal) That brings my situation to February 2014!!

Here is my questions:

1) Could I assume (since AP and EAD) are very important to me...that if we got married (next week) and the local field office (Las Vegas) is running at about 4-5 months...That if we start over doing CR1 I have a better chance of getting the Visa sooner than K1? (MUST BE LESS THAN 1 YEAR?) We don't have a lot of time in K1.

2) Do you still have the same wait times for CR1 at USCIS as with K1?

3) Do they consider length of marriage ie: petitioning 1 week after being married?

4) Are CR1's sent to Chicago? or do they go to Chicago and then directly to your local USCIS?

5) We are only 1 month into K1 and are willing to absorb the fee..Would you gamble that CR1 would be faster?

6) How can you prove the marriage if you just got married and are living separate..for items like mutual lease, ownership of property, ongoing banking etc?

Does the short time being married impact your CR1 (i do realize they look at over 2 years a bit differently) I mean for granting it!

1. Pretty safe assumption considering how CSC is going right now.

2. Yes and no. Depends on how long it takes for processing at your local FO. It’s a bit longer at NVC because a lot of our docs are filed there however NVC schedules CR-1 interviews whereas K-1s make there own on a who signs on and gets the appointments basis. You could luck out and get an appointment right away as a K-1 or it can go the other way as well. I have seen many threads on here where K-1s are trying to help each other get appointments because there are too many applicants vying for appointment times.

3. No. You will need to show an on-going relationship though. I included flight itineraries with our petition to show our travel to each other as part of other proof.

4. Not quite. Chicago is a mailroom basically. The sort the mail and send it to where it gets processed. MSC or FO in this case.

5. Absolutely I would. CR-1 is a better visa for you considering your Dad and your desire to work faster. CR-1s can claim EI from Canada if they’re eligible because they have the green card automatically crossing the border (and therefore the authority to work).

6. I flew home from the wedding. I added hubby to my life insurance policy (1 doc). He added me to his work life insurance (1 doc) and his car insurance (1 doc). I got a US RBC account over the phone and then we added him to it over the phone when we were together in one location (1 doc). You CAN get the financial co-mingling docs together and fairly quickly and easily as a Canadian. Just be creative based on your situation.

Don't worry too much about the evidence, you can just prove some communication, travel, maybe a photo or two, and with that you should be fine.
