Hi VJ,

I entered the US with a K1 visa, married my fiancee, and now am about to submit the AoS package. Unfortunately my I-94 has expired so I hope that won't be a problem. I have other problems though.

I'll mail the package tomorrow (April 1st). The problem is, we will move out of this apartment in August. From what I've seen here I highly doubt that I'll have my green card by then.

On the forms, I put my address as the current apartment, but before the process is over I'll have to change it. So how hard & problematic would that be? I think something's gonna go wrong about that, such as some important thing being mailed to the old address, and me never getting it.

Would it make more sense for me to put in my mother-in-law's address instead? She's in the same state as us, only obviously we don't live there. So would that be wrong, or suspicious, to put in that address?

This also brings me to my second point. My wife's going to school so we can't meet the income requirements, so my mother-in-law is going to be the co-sponsor, and she's filled out the I-864. In this case, would my wife need to fill out the I-864 as well, or is my mother-in-law's I864 enough?

Thanks a lot for your attention!

Summary:

Question 1: I'm filing for AoS but will move out of this apartment in 4-5 months. Can I put in my mother-in-law's address on the forms so there will be no address change and problems related to that?

Question 2: My mother-in-law is co-sponsoring me since my wife is a student. Does my wife need to fill out the I-864 form too?

You change your address by going to the USCIS website, the immigrant and the US citizen up date their address and then you phone USCIS and inform them of the address change as well.

You can do either. You can file the AOS package with the current address and then file the AR-11 on-line and since you have a pending case file it as instructed for a pending case. Also, you wife will need to file the I-865 to change her address. Make certain you sign up for electronic notifications and go to the UPSP to have your address changed. The notices will not be forwarded, but you will receive an e-amil that it was returned and you can call them to have it sent to the new address. Or you can use your MIL's address. Just remember when you put down your residences for ROC and naturalization you will have an address that the USCIS does not have for you. If that worries you than use where you actually live. If it does not bother you, than use your MIL's address.

Just so you know the USCIS cannot even get the address of their application support centers (ASC) correct. We received our biometrics appointment letter and the address was 15037 suite E which is a Smoker's Friendly store not the ASC. The ASC is in suite G. Now maybe they are trying to tell us something; like go in have a smoke or two because it is a very long wait  .

Good luck,

Dave

Hmm. Thanks for the info. But do you think that process would go smoothly? I mean, would I really be instantly updated on USCIS so that they'd never send a document to the wrong address?

Dave&Roza, thanks for the reply. I'm more concerned with the fact that I don't actually live with my MIL, so if I say I do, that's just incorrect information. I feel like that might be a problem during the interview etc. We actually live in Northern Virginia, and my wife goes to school here, and my MIL lives in Southern Virginia.

I don't remember, but isn't there an option for a living address and for a postal address? You could use your MIL's for correspondence.

And yes, your wife will have to fill in the affidavit of support + her last year's tax return or a letter explaining why she did not fill.
