On the DS-260 it states:

Is your spouse immigrating to the US with you?

I put no because she's already living there.

Is your spouse immigrating to the US at a later date to join you?

I put no here, too, since she is already there.

Plus I feel the answers should be no because she's a US citizen and doesn't need to immigrate. Am I answering these questions properly? I would think so. It's just that they are kind of weird to ask if she is a US citizen.

The answers are no. Remember this is a general form so might be used if people are applying for other types of visas where their spouse would actually be immigrating with them. :)

Oh...ok. Thanks for the help. That's what I thought. I just wasn't sure.

The last question I have is in Medical & Health. It states:

Do you have documentation to establish that you have received vaccinations in accordance with U.S. law?

Well, I'm getting them all done and I have to have them done at the medical. I'm assuming I should answer yes to this since I will have all of the required vaccinations at the date of my immigration medical.

Is that right?

Angeljay, yes it's okay to have 2 joint sponsors. Lots of people do that when they have the petitioner's parents help out. And since the parents are together and file taxes together, then the second sponsor fills out an I-864A, like I listed above. You just need to decide who will be the main joint sponsor and go from there.

Don't forget, you need to include documents from both of them, as well as your husband.

Hi Saylin,

On that matter, our joint sponsors are my parents in law. However, they are divorced and we will be living with my mother in law. My father in law makes the most money out of the 2 (eventhough he is retired). So here is what I will get them to do:

I-864: husband

I-864: father in law

I-864a: mother in law.

Is that right?

Also, can the joint sponsors sponsor all 3 of our applications?

Hey! Quick question - If I'm over visiting the US on an ESTA before my interview date...is proof of my interview date evidence of my intended return to the UK or should I avoid mentioning it?

I can't decide whether they will see it as 'well of course she's going to return to the UK because it would be dumb to stay illegally when she has an interview for a legal visa' or whether they will view it as 'she's gonna try and stay and we know she wants to'. Does that make sense? Lol!

The custom officer asked me the reason for my visit, why my husband lived in the US while I lived in France... And asked me to show him my return ticket, which I did.

He then let me pass with a big smile.

I did have a whole lot of documents such as work contract, lease and other doctor appointments for my son in case but he never asked.

I think it is good to gather as much docs as you can to prove your return as you never know what mood the custom officer may be in...

Yeah I did the same... I said yes as well.... And at the time I was still waiting for my Tdap, but as of now I believe I have everything.

Hi!

We re in the US right on an ESTA and leaving in 10 days.

I think it is good to gather as much docs as you can to prove your return as you never know what mood the custom officer may be in...

I think the return ticket is part of international travel law applied to pleasures travelers and must acquired round trip ticket. In some countries custom officer will ask you to show them your return flight if you don't have one you can't go pass that gate. When you checking in at your local international airport they will catch it and won't allow you on board until you have a return flight and/or at least 6 months valid on your passport before it expired. Those 2 things they usually looks at first in rare occasion like me they let me on and I was stuck at Sydney for 7hrs. I learned this one the hard way.

I'm thinking they reviewed (and accepted) either the DS-260 or the IV package for your case. I'd suggest calling up though to find out. Got less than 2 hours!

Husband = I-864

Main joint sponsor = I-864

Joint sponsor's spouse = I-864A

You need to choose one or the other for the main joint sponsor. They'll fill out the I-864. It should probably be the one who earns more. Then, the spouse will fill out an I-864A. You can't submit one form for two people. That's not how it works.

What exactly do you mean by 'again'?

Sorry Saylin, I included 2010 and 2011 with I-864. 2012 income tax was mailed to IRS in March, does 2012 also need to be submitted at the interview?

The same thing happen my approval was January 29,2013 but USCIS did not send it towards to 90days . But last April 16, USCIS email us that my approve/reaffirmed case was send to National VIsa Center for Visa Processing.

so my father n law is the main sponsor, he will still file i-864 even though they live in same house with my husband? or the main sponsor and the spouse will fill up i-864a each? sorry saylin just want to clarify things bit so confused.

Not sure this going to help you or not but it something to start out with I-864 USCIS instructions.

I believed the first sponsor fill out I-864A if you don't meet PG and you listed his/her income on your I-864 and checked the box him/her will fill out I-864A, now if you have children coming along with you and the first sponsor didn't makes enough to support the rest, this where joined sponsor coming in and fill out a separate I-864 for the rest of the crew. I may be reading it wrong......but I remember reading it somewhere and that's how work with AOS.

If you CURRENTLY don't have any documentation of vaccines, then it's no, as you saw on that thread you linked to.

You answered right good.gif If you have documentation, you say yes and include an explanation. If you don't currently have documentation, then you say no.

If you didn't include 2012 tax information in the AOS package, then you'll certainly need it for the interview as it's now past the tax deadline and 2012 tax information is now required.

We chose them both as my father in law earns well above the PG but won't live with us and is retired and my mother in law also earns more than the PG and we'll live with her.
