If you are a citizen, your child will become a citizen automatically once s/he arrives with immigrant status.

You are correct in your quoted statement above, as it is explained in the following link to the law:

- Child Citizenship Act

The Child Citizenship Act (CCA) which becomes effective on February 27, 2001,

amends the Immigration and Nationality Act (INA) to provide U.S. citizenship to certain

foreign-born children—including adopted children—of U.S. citizens. In general, children

who are less than 18 years of age and have at least one parent who is a U.S. citizen

whether by birth or naturalization-will benefit from this new law. Under the law,

qualifying children who immigrate to the United States with a U.S. citizen parent

automatically acquire U.S. citizenship; children who live abroad acquire citizenship by

application.

Just curious: did you had the same situation; meaning at the time when your child born in foreign country, you or your spouse was a LPR?

And then your minor child entered to the US with immigrant visa?

My case is similar but a little different.

My minor stepchild will become a citizen as well, because her father became a citizen last year. I petitioned for her as a stepmom, and therefore since she isn't getting her derivative US citizen status from me, I couldn't file 864W. I petitioned a few months before her father became a citizen. If he had been the petitioner, after he became a citizen, he would have used the I864W form.

No, hubby unfortunately does not have a job lined up back in the US :( I wish he did but hopefully our lease with my FIL/MIL and their letter stating that will support us for when we move will suffice for proving domicile. fingers crossed!

There's a bit in the I-864 instructions for proving up USA Domicile.

For returning expats, they have 2 choices, for showing proof of USA Domicile:

1. proof of USA domicile or

2. proof of re-establishing USA domicile.

so, if you are NOT submitting this stuff in with the I-864 (usually cover letter with a list of evidence supporting USA domicile stuff) then

USCitizen must provide it the beneficiary, on interview day, for the beneficiary to show to the Vice-Consul. It's important, don't slip on this one. Canadiens have a pinned topic about it, as well - I hope you've made time to review it.

Ugh, I had a feeling they kept track of the calls :blink: I already called this morning, and again no case complete yet, and I was thinking that I would call again later this evening.... but maybe I will just wait until tomorrow instead :unsure:

The money was debited out of my account Monday evening. It did not show up as PAID until this morning. How long ago was the money debited from your account?

I'm not sure. I asked my wife to tell me when the fees have been taken out yesterday and she told me they were both taken out already. I'll have to ask her specifically when the AOS fee was taken out. I'll wait a few more days (Monday next week) and if it still shows IN PROCESS then I'll call NVC about it, too.

My case is similar but a little different.

If he had been the petitioner, after he became a citizen, he would have used the I864W form.

Apparently the secretary of immigration lawyer whom i used to verify my AOS form entries, did not know this fact...

As a result, i am loosing some time with this RFE (or checklist) which could be easily prevented :(:bonk:

Somehow, the secretary of immigration lawyer whom i used to verify my AOS form entries, did not know this fact...

As a result, i am loosing some time with this RFE (or checklist) which could be easily prevented :(:bonk:

You should issue an invoice for partial refund of fees, suggest 15 percent of what you've already paid.

Then when the attorney doesn't pay up, take said attorney to small claims court and get a monetary judgement against the lawyer.

If you do this (and others do it) then 'being ignorant' proves costly for these attorneys. I Cry when I read of members bound to Guangzhou, who's attorneys were clueless about EP for Guangzhou and delayed them 4 months and 5 months in being reunited with their families.

Seriously, submit an invoice back to said attorney.

I've had that bookmarked on my browser since day 1. I have compiled everything that I could get for proof of re-establishing and sent them along with the AOS packet thru EP. I'm just hoping it's good enough! Many thanks for the heads up, very much appreciated.

The thing is, if the money is still being held, then it isnt exactly paid yet. I noticed the money pending in my bank acct, so I was confident that the payment was ok. However, it wasnt until the transactions were actually posted and the money was actually gone from my acct that the status changed to paid. Im not sure why your iv fee, which you paid after was processed and the aos wouldnt be, were they from the same bank? Sometimes when payments are initiated on a weekend through your bank, they dont start the process til the following business day. I would give it until tomorrow.

I tell people all the time that this forum is such a wealth of information that its useless to go to lawyers. They are being paid to do what we can do ourselves so much more efficiently. People offer so much assistance, and share all the knowledge they gain along the way.

Ive done everything from bringing my hubby here on a fiance visa to him becoming a citizen, and now bringing his daughter here with only the help of visajourney. I owe my whole family and happiness to vj.

Then when the attorney doesn't pay up, take said attorney to small claims court and get a monetary judgement against the lawyer.
