Hi Saylin,

Sorry to bug you again with I-864 question. We fullfil all the requirements for using I-864EZ as per the AOS Instruction on http://travel.state.gov/visa/immigrants/info/info_3197.html. Should we be using I-864ez or I-864. What is the general practice. Please clarify.

Just because you qualify to use the I-864EZ doesn't mean you NEED to use it. You can use either or in your case. But if you qualify then I suggest the I-864EZ as it's a much shorter form!

I'm not sure I qualified to use the I-864EZ because all of my income did not come from wages last year (I had capital gains too). But my wages were plenty as is so I am fine either way. I didn't find the I-864 difficult because I didn't need to fill out most of it anyway.

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

Oh, I think I might have screwed up, goddammit... help!!!

I just sent the I-864 form. I was going to use the I-864EZ form because I was only using wages to establish eligibility to sponsor, but I reconsidered because I had capital gains on my tax form also and I thought I had better use the long form. I just noticed there is a difference between the checklist for the long form (I-864) and the checklist for the I-864EZ form. The EZ form checklist does not mention sending pay stubs or an employer letter. The long form does mention sending them. This is what I sent with the I-864 long form:

Bar-coded cover sheet

2012 tax filing, all forms and schedules including signatures and a copy of my W-2

2011 tax transcript

2010 tax transcript

2009 tax transcript (I had a copy of it and I included it just for reference)

Will that be enough? I have been working in the same job for 10 years and my W2 wages are over 40K USD each year. Will they ask for a letter from my employer or for recent pay stubs? I can send them but I've already sent off the packet.

I have a headache. :bonk:

how are you all getting IV fee bill notices within a day or two of your AOS fee bill notice? I want to pay the IV bill but the NVC rep told me it could take 10 to 15 days after receiving the notification of agent and address.

Got ours the same day as DS-3032 approved but it was nearly a week after AoS not sure how they are getting them faster, must just be faster DS-3032 approvals going out!

Since you included 2012 tax information, they MAY accept the package without employment letter and/or pay stubs. You'll just have to wait and see...

Hey Salin,

I had mailed my AOS package, but received a checklist on some additional items they needed. They want an explanation of why taxes weren't filed (for the three most recent years). Would that be 2009, '10 and '11? I was asking because I don't think I'll be able to mail them the forms they need until next Monday, which is the 15th of April and that's when taxes should have been filed by. However, this is my case:

2009,2010,2011: I was a full time student, a dependent, and unemployed with no income

2012: I was also a full time student, a dependent, and worked part-time so I did not file because my income was below the requirement.

This is from NVC:

[x] It appears that there is no proof of current employment (a recently dated job letter or pay stub), or of

self-employment status (a recently dated letter on business letterhead or a business license).

[x] A written statement/explanation as to why tax returns were not filed is required if you are/have been

unemployed, retired or dependent.

[x] The submitted income tax documents/IRS statements for the years marked below are missing/incomplete (if

you have lost any of the requested tax information, contact your local IRS office to obtain a copy) (Only

Federal returns (not state or local) are acceptable unless the sponsor's income was earned in Puerto Rico.)

• Schedules are missing for the year(s):

[x] 2011 [ ] 2010 [ ] 2009 [ ] 2008.

• Federal income tax returns, literal printouts from the IRS (RTFTP) or a Letter 1722 issued by IRS

I called NVC and asked her what year they needed my letter for, and she said only for 2011. My question is, that should I go ahead and also write about why I didn't file for the 2012 year along with it? I don't want them to send me another RFE/checklist for 2012 to ask why I didn't file, but I also don't want to send them additional info and make the situation cloudy. Other than that, I am going to send in my current pay stub and I had already sent them my W2s for 2012. Please help!!

Question. I submitted the DS-261 yesterday. Neither the AOS nor the IV bills were invoiced. How long does it take normally for NVC to invoice these? I'm not panicking or anything. I read the posts that they might be working on billing them (since it is saying that they no longer recognize my numbers when trying to login). I'm just wondering. I think one of the posts said that it takes about 15 days for the IV to be invoiced from the time that you submit the DS-261. But I'm more wondering about the AOS.

Typically the AOS is invoiced a few days after the case number is assigned. You're signing onto the payment portal on IE, right?
