Hiya ppl,

I have a quick question, hopefully answer is even quicker :D. We are using my income (sponsored immigrant) to qualify for Affidavit. I make much more then required and I am working since I came to the USA (almost two yrs ago). My husband was a full-time student till May 2006 and now he is working as independant contractor. I am guessing everything is ok with our paperwork since we received AOS interview NOA. I am still a bit concerned since Tim didn't make enough in this year to qualify. Will my income be enough? I would like to hear from people who had same/similar problem. Thanks!!!

I used my own income for the Affidavit of Support as my wife is a student and last year earned $0. The issue never even came up at the interview as far as I can remember. My guess is that if you haven't got an RFE about the Affidavit, you're fine.

I was reading the instructions on the forms, and the intending immigrant beneficiary (wife) can file an I-864A as a member of household, and the sponsor petitioner (husband) files an I-864.

How Can the Intending Immigrant Be Considered a Household Member?

Listed below are two ways that the intending immigrant may be considered to be a household member for the purposes of pooling income with the sponsor to meet the Affidavit of Support requirements:

  • The intending immigrant has the same principal residence as the sponsor and the intending immigrant can establish that his or her income will continue from the same source, even after acquisition of permanent residence.
  • The intending immigrant is the sponsor's spouse and the intending immigrant can show that his or her income will continue from the same source after acquisition of permanent residence.

Glorya,

Your income can be included with your husband's on his I-864. All other things being satisfactory (they may not be, but you don't provide information about any other things), if your income alone is adequate then your combined incomes will be adequate.
