I-130 USC - Parents - I-864 Affidavit of Support (AOS)

Our daughter who is an American citizen living in Austin, Texas recently filed for my wife and I who are her parents, both I-130 have been approved by USCIS and the matter is presently with the National Visa Center (NVC) for processing. We are aware that our daughter will be required to file a I-864 Affidavit of Support, however, she is not presently employed as she and her husband decided that she should stay home and raise there two kids (our Grandkids, ages 7 & 1). However, her husband is employed as an Executive Chief as a leading Houston, Texas hotel and will be joint sponsor.

As a consequence, we are seeking to determine what forms will both my daughter as the main sponsor and our Son-in-law (her husband) as joint sponsor will be required to complete.

All responses to this inquire will be greatly appreciated.

Congratulations for your NOA2 approval. Please kindly update your timeline. I have same issue too but my NOA2 is yet to be approved. However, i decided to research ahead of my approval. You could ask your daughter to call the local tax office and explain the situation to them and ask for a written statement of waiver or exemption from filing tax . My wife is a USC and not yet employed cos she is raising our 10 month old daughter. Just give it a try and post an update to guide us too.

Your daughter, as the petitioner, will have to fill out an I-864 even if she hasn't filed taxes. Since she's not working, she's going to have to write a letter explaining why she hasn't filed for the past three years and attach it to the form. Just so you know, her husband is going to have to make a significant amount in order to be sufficient as joint sponsor - since his household for merely his family is four, he'll need to make at least enough to cover a household of six, which would be 38,712$.

If he does meet the requirements, I'm pretty sure he'd just have to fill out an I-864a, since he shares a household with the main sponsor, your daughter. Aside from that he'll need his IRS receipts for the past three years, pay stubs from the past six months, and an employment letter from his boss.

Hi Folks, I am having some difficulty understanding the I-864 Affidavit of Support (AOS) form and specifically Part 3 questions 8 & 9. Question 8 (two part question) first check box ask the following question, I am sponsoring the principal immigrant named in Part 2 above, the second question (two check boxes) is as follow, Yes (1st check box) or No (2nd check box) (Applicable only in case with two joint sponsors). Question 9 check box is as follows: I am the following family member immigrating at the same time or within six months of the principal immigrant named in Part 2 above. Do not include any relative listed on a separate petition.

I am somewhat confused especially as it relates to question 9 in that my wife and I will be immigrating at the same time (assuming that our application is approved by NVC), however, she cannot be added to the AOS that my daughter will be preparing for me based on the fact that she (my wife) has a separate visa petition. In addition, will our daughter be required to prepare a separate I-864 AOS for her mother (my wife)?. As usual all suggestions/comments will be greatly appreciated.

I am also Petioning both parents. And my answer in #8 is "YES". did NOT check #9 since I am filing a separate petition for each parent. And my answer in #10 is "1"
