My wife and my son are here in the US visiting me from Canada (they were not stopped at border). I am a US Citizen and I have filed for the I-130 for the two of them. Their I-130's have been approved, but I found out about AOS. Does anyone know if it is possible for me to file the I-485 and let them stay with me or should they go back and wait for consular processing? We've been apart for quite a long time and it's hard to see them go again!

Pryme57,

Have a consultation with an immigration attorney who does family-based immigration work. They will review the details of your situation (which you have not provided here in your post) with you and advise accordingly.

Pryme,

The AILA web site has a locator by city for their member attornies. Being an AILA member does not guarantee that a lawyer is a 'good' one, but it's a start.

Getting recommendatios from satisfied customers, as you're seeking to do here, is good. Then even with recommendations you'll want to speak with them as you have started doing.

One thing I would say is that anyone - attorney or not - who gives you answers without first delving into your details should be passed over.

Thanks for the response. I did make quite a few phone calls to lawyers yesterday and got varying answers. Anyone recommend a good lawyer?
