Hi all, I'm new to this site.

I am currently a grad student graduating soon. My wife and I got married last yr Nov. Before we got married I filed my precompletion OPT and got the card after our marriage. I started employment in Jan of this year. My Precomp OPT expires in a few weeks. We filed i485, i765,i130. However due to my wife not reaching poverty guidelines we did not meet the standard and we got an RFE to for i864.

Here are our concerns.

1. How does this affect my EAD. Especially since I have one currently which expires on the 13th of April.

2. Do I take some time off work or can I go to the local USCIS office and request an interim EAD.

3. Our family friend who happens to share a house with us has agreed to be a joint sponsor. Are we all in the same household since we live in the same house? we are not dependent on him in any other way except this new i864

No you are not. Only his dependents.( the ones he claims on his taxes )

Adjusting from B1/B2

Exactly 3 months from the day we got married till the day I had both SSN and GREENCARD in hand !

Day 1 01/22/2013 AOS package sent

Day 8 01/28/2013 NOA 1 received

Day 15 02/04/2013Biometrics appt letter for 2/25/2013

Day 16 02/05/2013 Succesful walk in biometrics 20 days early

Day 25 02/14/2013 USCIS status changed to Testing and Interview ready for interview scheduling

Day 31 02/20/2013 Email notification that my interview is scheduled for March 21st

Day 57 03/19/2013 EAD/AP card ordered

Day 59 03/21/2013 Interview at 10.30 am Seattle Approved

Day 67 03/29/ 2013 Greencard Arrived . Applied for SSN

Day 68 03/30/2013 EAD arrived

Day 74 04/03/2013 SSN card arrived

Eligible for ROC December 21st 2014

1. it doesn't affect your current one but your one based on AOS will not be processed until you respond to the RFE

2. Nope. when it expires, it expires. You could try an expedite but doubtful it would be approved until you respond to the RFE anyway

3. If the household member completes an I-864 they only include their household (spouse, kids - no matter where they live etc) plus the immigrant. if the household member does an I-864A then they are added to your household count.
