It only REQUIRES the most current year, but you can send up to 3 years worth. If he didn't make enough those three years, it's pointless to send it and he should send an employment letter and pay stubs if they show his YTD or annual income.

Thank you! But the problem is there are only two check box on the form, one is saying I have filed a federal tax return for each of the three years....and another check box saying (optional)I have attached photocopies or transcripts of my federal tax returns for my second and third most recent years. Neither of them we can check because he didnt have three years tax return...Should we just leave there uncheck? He didnt make enough to support me yet, but his mother can help us, if his mother and us not leaving together, can we still have his mother's help? Thank you very much!

It says:

I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year.

If you did not have to file a return, then you put 0.00 and attach a letter explaining why there was no tax return done. OR you can file a tax return understanding that the amount you would have to pay would be zero but also the amount you get back is zero.

When I was in college I made very little money. Only 2 weeks working for my mom during xmas and the next year another 2 weeks working for the school during xmas. I still filed tax returns. Mostly because Canada has a special write off section that carries forward until it's all used both federally and provincially for tuition, books and education.

Check the one that states you are including only the most recent year. For the other 2 years put something like "N/A-SEE ATTACHMENT" and include a statement as to why he was not required to file taxes those 2 previous years.

No, it does not. It asks for information from three tax returns but only requires that the most recent be included. In the section asking for past tax return info, enter the information from the 2012 tax return and then hand write in the available space, "Not required to file in 2010 and 2011 due to no income." If he had SOME income but not enough to require filing, change "no income" to "income below filing threshold".

Oh, so you can put the statement of not filing directly on the form and not bother with an extra sheet. Good to know.
