Do you need a GC to do a Quitclaim Deed to have joint house ownership?

Do you have to already have your conditional GC to do a quitclaim deed? We were considering doing this, but were told that I need to have the GC to have joint ownership. Is this true? Or can we go ahead with the quitclaim deed now? (I am on a K-1 visa, waiting for 485 to be approved, no AOS interview yet) Thanks!

Please, someone, correct me if I'm wrong, but isn't quit-claim deed used to basically give up the "interest/stake" in the ownership?..

Foreigners without residency can buy property in the USA, so I would assume you can, but the exact laws are state dependant.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

That would be something to ask of a lawyer in your state. Property laws are state things, so not at all the same across the US. If you are in a rush to do that just because of the interview, it really isn't a necessary thing to do. We've gone from K1 to AOS to Removing Conditions to Citizenship without joint ownership of our house. We even bought a new house and didn't get it both names. It's not a requirement for immigration, but if it's something you want to do, ask in your state if it would make any difference if your spouse is a permanent resident or not.

Contact a family law and real-estate attorney, for the best advice. Due to declining values I did not want to encumber debt to my spouse, you can always change later. It is not a requirement for immigration.

I did the quit claim to add my husband to the deed. It does not give him any debt because it does not add him to the mortgage. It does show we have joint ownership in property.

Some people rent and some live with relatives or in military housing so it is not a requirement. I just wanted to share everything since we are married.
