Hi,

I am wondering about what will happen to my ex-husband whom I married in the US. He is a conditional green card holder while I am a US citizen. We married and after about 10 months his green card arrived and he took off to Russia for 7 months and was working there full-time! Anyways, it became obvious that I was scammed for a green card, so it turns out that he did not live with me at all after obtaining his US residency. Another important factor in this is that I filed for divorce after a year of marriage and after 2 months of the arrival of his green card, so you can tell that not only we did not live together AFTER his green card arrived, but that I petitioned for divorce after just 2 months from the time the card arrived.

Anyways, for this reason he has NO documentation (joint) to present to immigration, and the only thing he is limited to are a few witness affidavits, but from what I understand a few of these only will not help him out as he can request his friends to write anything he wants them to write. I would assume that when he submits these witness affidavit, the USCIS will request more proof from him, especially financial proof.

I already notified the USCIS of this...that he did not live with me at all after getting his conditional status, so I am hoping that they put my report in his file. In addition, what will happen to someone who can not present not single doc to immigration pertaining joint things with me, proof that he lived with me and all that. Is he going to automatically be denied the waiver (we're now divorced) when he applies for i-751 or what.

In addition, I heard that he might try to self-petition for an Eb1A as an artist, but not sure if jumping from one green card, which you already have to another is allowed and how immigration would look at that. Will he automatically get denied the eb1a when they see that he is still a conditional g.c. holder. Would that then make them request the removal of his conditional g.c. through our marriage in the first place.

I am trying to understand the situation he is in in terms of the USCIS's perspective. Any advice would be appreciated.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

She has a right to be curious and a right to be answered by a person who has an answer to her question.

Shilaci most likely he will have a very hard time if in fact you told uscis that he wasn't living with you. But he still can do the artist visa regardless.

No he came back after 7 months being there since he was worried that staying overseas longer will impact him negatively. Yes, we are divorced now and I am looking to find answers here not be asked why I care what will happen to him or not, that's not why i spent time posting here. Leave that up to me please why I care or not...I am trying to understand what he has in store for based on the info/situation I have provided here. You are right in that its his issue, but it does not stop me from understanding the type of situation he is in.

Now that it's been moved to an appropriate forum...

To OP:

- He'll have a very hard time filing ROC with the divorce waiver

- As far as an artist thing, if he does file that, his name will come up connected with the GC he got through you.

All in all, it's impossible to say what USCIS (i.e. the adjudicator) will think or do when your ex-husband files for whatever he might file for. Too many improbable possibilities.

All you can do is "understand" it, but it seems like even you have no idea what your ex-husband is planning to do next.

There's almost nothing you can do to prevent him from doing whatever he's going to do to try and stay in this country.

You'll get answers, yes. They will have no bearing on reality and will only fuel the speculative nature of this issue.

Ok, guys...I am not here to be told to divorce him and move on and if you guys read my thread then you should have seen that I said that we are divorced.

Let it be my issue to move on or not and please keep that to yourselves because that was not my question. I got bunch of replies, but no one has yet been able to give opinion specifically on the issue. I am only hearing to divorce him (when I'm already divorced) and to move on.

Has anyone here been denied their I-751 for no proof whatsoever.

Thanks for your comment! I understand that we can only speculate, but I thought about asking in here as people have different experiences with i-751 based on how much or less they have submitted. But one thing I know for sure is that my ex has NO joint docs, so his only option is to present fraud ones, which he will never do lol. So that is why I wanted to understand if there are instances when people can get their permanent g.c. without any proof/docs...but it seems impossible from reading your post :) Thanks!

P.S. I guess before even getting to his eb1a...my direct question here should have been the following:

CAN HE FILE FOR I-751 AS A DIVORCED IMMIGRANT WITHOUT SHOWING ANYTHING TO IMMIGRATION (ONLY SOME WITNESS AFFIDAVITS)...HAVE YOU SEEN ANYONE GETTING THEIR GREEN CARDS BY NOT PROVING THE USCIS ANY PROOF OF BONAFIDE MARRIAGE. I AM ASSUMING THAT MY FRAUD REPORT ON FILE WILL NOT HELP HIM EITHER WHEN THE USCIS ASKS FOR DOCS AND GETS NOTHING FROM HIM. THE ONLY WAY HE CAN PROVIDE DOCS IS IF HE MAKES THOSE HIMSELF FROM HOME THROUGH PHOTOSHOP LOL

SO I AM more concerned with his i-751 now. it seems to me here that even married couples with some joint docs in their possession sometimes get denied, so it seems that my ex has a very slim chance of getting a permanent green card while not submitting anything besides his i-7514 form.

How are you so sure he has no proof of bonafide marriage. And yes, he has a slim to none chance if he does not have evidence.

From what I see is that people here ASK QUESTIONS.

I am here to find answers in trying to figure out if in my situation my ex can get his g.c. through me or not. It's really none of your business how or when I should move on or whether I should inquire about his situation or not. I do not think you have a right to tell me that I should not ask question here about i-751 process pertaining to the situation I found myself in with my ex. Why even spend your time to teach me what to think or what to do or what I should be asking or not. It's like people have nothing else to do. Instead of wasting a few minutes of your time writing me your comment, you could have given your input into the situation...that would have been nicer and more productive thing to do on our behalf.

I do not understand how its any of your business in here to teach me about moving on or not inquiring about my ex when. Cease all the questions in here from other members and I will cease mine. the way you mention that I am a US citizen as if US citizens are banned from coming to this site.

I know for sure because when we got married, we lived with my parents as we were trying to find jobs to move to another city...at least that was the plan. That was a year an a half ago approx., so the economy sucked big time. While living with parents (who were making good money), we did not have expenses as my parents were paying their mortgage and their utilities themselves. Anyways, so once his g.c. arrived the plan was to move to another city to start our lives together, but he took off once his g.c. arrived, so this is how there are no joint bills for us at all. This is also why he has nothing to show to the USCIS. Hope I answered your question. :)

P.S. He was not bright if he thought that once he has his green card, then that's it for him :)
