I-864 (Joint Sponsor Question)

Hello VJers,

My wife & I don't qualify so we're using my brother-in-law to assist us in meeting the income requirement. We have his 2011 tax return (being the most recent tax year) included in our AOS package, as well as his W2's. However, it's about to be April 17th, what does USCIS define as most recent ? I mean he's made way more than enough for the tax years 2009, 2010, & 2011 to sponsor us. I'm assuming the 2011 tax return should suffice right ? He works on average about 13 hours a day (a doctor constantly on-call and has 3 kids), and told me that he files extensions yearly cause he almost never has enough time to get his taxes filed by the deadline. By this time of the year is USCIS requesting 2012 tax returns ? Anyone know ?

Arrived in the U.S - August 17th, 2006 on F1 Visa
Met "then" girlfriend - March 2009
Graduated - December 17th, 2011
Applied for Post-Graduation Work Permit (OPT) - Jan, 23rd 2012
Work Permit (OPT) Denied for "late submission into SEVIS system" - Received Denial Letter April 3rd, 2012
Fell out of status ...:/
Married - September 10th, 2012
Mailed I-485/I-130/I-765 Packet - April 1st, 2013
Arrived at Chicago Lockbox - April 3rd, 2013
Received E-mail Acceptance Confirmation - April 10th, 2013
NOA1 - April 15th, 2013
Biometrics Appointment - Received notice on April 22nd. Appointment scheduled for May 6th, 2013

Received actual interview letter - May 17th for June 21st

Interview, June 21st. - No decision made. IO said we should expect to hear back from him in 2 - 3 weeks, that we can expect a visit or phone call just to verify. Interview started out fine, but IO didn't seem to like our living situation with a friend. We are hoping for the best ....

Aug 2nd - 6 weeks later. Still no word :/... Please send prayers

Moved on Aug 16th to our own place smile.png, after living with a friend for the longest.

Missed Officers Home Visit - October 25th

Officers visit Wife's Auntie's House - Nov 8th

Officers Interview Friend who wrote affidavit in app ??- Dec 20th

If you file before April 17th then 2011 will be enough, if you can get the 2012 from him they might ask to see it at interview.

From my personal experience of asking lawyers, forum and USCIS reps, the most recent tax year is 2012. Whether we are in Jan 2013 or April 2013, it doesn't matter..

Lots of debate around April 15 deadline.. but I would say if you send them 2011 they may send a RFE and ask for 2012 return..

I'm waiting on filing my taxes now for 2012 so I can send them my "most recent tax year" return!

Every situation is different though, you said he has made good amount of money in all 3 previous tax years..

One more thing, please do not send his extension paper as the most recent tax year return, USCIS will not like that :)
