hi everyone.

first of all, thank you for all your guidelines and discussions, it has helped me in so many ocassions!

anyway, I have a question.

my brother is an american citizen and he and his family are currently living in Portugal. however, he is moving to the USA in the beggining in may with his wife. she is going as an alien and as soon as they get there they will start the I-130 process for her, however, we already have all the N-600k forms filled out for both my nephews because the meet the requests and citizenship is always better than a green card, bue we don't know if we should send them now or not. they are going to finish school here, so they are just going in August so, no problems there because the citizenship will be done by then, however, will this complicate my sister-in-law visa process? I mean, can they "difficult" her green card because we already have her sons citizenship process running?

The wife will have to go back to Portugal. She cannot move to the USA then file the I-130 expecting to stay in the USA.

Your brother and the kids can move over as soon as the kids have their papers in order. The wife have to wait until she gets her visa. It can take anywhere between 8-10 months from sending in the paper work until visa in hand. Her coming as a tourist with the intent to adjust status is fraud and she could be banned...

Your brother must also have an income big enough to meet the requirements here in the US in order to be able to sponsor his wife. If not she needs a co-sponsor.

ok. there is no problem there. my brother already talked to a lawyer and she will help with that. do you know how long it will take and how soon she will have to come to portugal?

What kind of visa is she entering on, a tourist or a VWP? She can only stay as long as her visa allows her. She will have to go back to Portugal to do her medical exam and to have her interview. How long it takes for that is very hard to predict, uscis takes forever right now....

Is the lawyer taking care of all the paper work to be sent in? The best would be to send in his wife's I-130 as soon as possible....

You know that if you file i130 for the kids, once they step on USA soil they instantly become Us citizens. they enter Us with an immigrant visa but they automatically acquire Us citizenship?

i filed N600k for my daughter born abroad, i wasnt thinking right. she was denied of a US TOURIST visa so she couldnt attend her oath taking for the N600k application, which led to the abandonment of the application. wasted time! i should have filed I130 instead! lesson learned. (well, unless the children already got their temporary visa then thats fine, it takes the same time though with i130)..

btw, the US citizen parent of the children must be living abroad with the children in order for them to adjudicate the application.

whichever course u take, best of luck!
