Can anyone give me advise on how to divorce a man that I married in Morocco? I am in the USA, never filed papers, nothing.. I found out that he is a liar and just wants a green card.. I know, my mistake.. Now he will not divorce me in Morocco ~ Can I do this in USA?

If anyone can help it is so much appreciated.. Thank you all..

Was your marriage recognized in the USA (no filing of papers necessary - unless things have changed since I did it)? If so, then yes, you can do it from here. All you have to do is serve him there. He has 30 days to reply, if he doesn't, you get everything you want. If you want more info, just let me know. My divorce was successful from my Egyptian SOC. If it wasn't a recognized marriage in the USA, then I'm not sure what you would have to do.

2-26-09 - Visa in hand!

3-11-09 - POE JFK - Got stuck there due to immigration taking too long. They didn't change his visa from CR1 to IR1, have to go to immigration here to fix it.

3-12-09 - Arrived in Portland!!

5-29-2010 - Zane was born ** Absolute best day of my life!

6-7-2010 - Ahmed went back to Egypt

8-23-11 - Filed for divorce

1-12-12 - Divorce final

As far as I know it wasn't recognized in the USA, I wouldn't know how it would be.. I didn't do anything here in the USA or there at any USA Consulate, Embassy, etc..

Do you know how I would know if it is recognized in the USA?

I don't know how to know if it is recognized or not.. I mean if it's not recognized in USA, then I'm not married according to USA law right?

My first marriage over 10 years ago was in India with my ex immigrating here to the USA shortly after. We never registered it here in the USA, but I still had to divorce him legally (used an attorney). I asked several divorce attys and they YES said the marriage is still legally recognized in the USA even though we never registered it here.

I understand your husband is still in Morocco, but I would definitely contact a divorce attorney to cover yourself legally and divorce him from here.

Thank you for the information.. I know it would be easier if he did it from there, but he won't.. What a mess for me.. I'll contact a divorce attorney and get things done from here, I just want it done! I kick myself every time I think of my stupidity.. I'm educated, good job, but fall for a liar! It can happen in the USA too, I'm just grateful I never did anything to bring him here (Thank God for that)!

I appreciate you taking the time and I'll get to a divorce attorney from here asap! Of course, there goes money for my stupidity!

there are several different ways to handle this, but I would suggest a quick conversation with the clerk of the court that handles divorces in your area, asking about the proper format of the divorce filing document for a spouse not residing in the state.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Anything to do with unresolved mahr and other issues pertaining to the Moroccan marriage contract would probably have to be dealt with in Morocco though I imagine. (if any of these things are relevant to the OP) Also would definitely have to resolve things in Morocco if you wanted to remarry a Moroccan in the future.
