Hello VJ family,

Hubby received his CR-1 visa. I have a question about POE. I plan to fly out about 1-2 weeks before him into Atlanta (where we intend to live). Hubby plans to fly to Seattle where he has a 3-month internship opportunity. It is limited to those 3 months & after complete, he will join me in Atlanta, where I have a job. My question is: will it be a problem that I am in a diff state than his POE?

We have paperwork which states that the internship is 3 months only & paperwork which states that they will pay for his flights as long as they are into Seattle (we'd like not to have to pay for separate flights just for him to fly into the same city as me). We would also go ahead and purchase a ticket Seattle to Atlanta, to prove that he will join me in Atlanta once the internship finishes. I can also sign & send a letter w/my contact details as to why we are flying in separately and what our intentions are.

Is this feasible? Is it acceptable for the PR to fly into a state that is not their intended home without their USC spouse? Hope this all makes sense.

September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

He is a LPR and GC holder so he can re-enter the US anytime he travels internationally. Domestic travel is not an issue at all. You can live in two seperate states. The only issue will be how the USCIS looks at it for removal of conditions (ROC) and I do not see a problem with that either. I would keep the paper work for ROC, but other than that no issues.

Say, after he joins me when the internship is finished & then needs to go back to the UK to participate in his graduation, and close his affairs, this is ok, as long as he isn't gone more than 6 months?

Yep. That is why he has a GC. The real limit is 1 year, but there are issues once you hit the 6 month mark. Less than 6 months and a single trip in a years time not a problem.

Thanks for the advice. Would this scenario be acceptable: hubby has to go back to UK after 3 months internship to tie everything up (say, he takes 3 months to do this), comes back to the US for 2 months (where he will live & work) then needs to make occasional trips to UK for business? Would immigration find this to be a problem?

Sorry for all the questions/scenarios. We're just trying to think through everything properly so that we aren't violating any laws/looking fishy to immigration.

You guys should be fine.

Though I have to say Seattle was never a fun POE for me even as a USC. I always seemed to get grilled there coming in from Egypt. I don't get that at other POE's.

AS long as he is in the US more than out of the US in a 1 year period there will be no problems. If he needs to be out of the US longer than 6 months in a 1 year period he MAY get questioned more. As long as he has proof that he is not abandoning his LPR status--i.e. work in the UK for a bit and moving his stuff to the US is not what I would call abandoning his LPR status (there are those that get the GC and want to LIVE in their home county and maintain their LPR status). Sounds to me like he will be fine.

You guys will be fine HOWEVER at the POE they will ask him to update his permanent address which is where he will be entered as permanently residing in the US. You will be wanting him to give YOUR address where you will be living in Atlanta and that is where they will send his GC and SS card. If he enters the US and gives them a Seattle address and you have an Atlanta address the two different addresses will be in the system from day 1 and that will be something to overcome.

It doesn't matter what he does as long as the two of you share the same permanent / fixed residence for the duration of time between POE and ROC.

He might be temporarily in Seattle but he needs a Georgia drivers license and a Georgia car and Georgia license plate and Georgia insurance that matches your Atlanta address.

Separate the two from day one and you are really inviting ROC trouble.

Atlanta as a POE is a smooth experience. We never had any problems.

I was just gonna say the opposite, I've always found Seattle the easiest and fastest POE. This year is the first time I will re-enter with a greencard. Curious to see if it is any different nervousness wise :)
