Social Security and Driver's License HELP!!!

Sooo.... I'm hoping someone can help me here.

My Husband entered the US on 02/24/13 on the K1 visa and we wed on 03/08/13. We went to the social security office on the 11th and they told him they couldn't issue him a social security card because the system wouldn't allow them to and that the I-94 was going to expire March 24th...(which didn't make sense to me because i thought it was good for 90 days and the i-94 has a date of may24) and she gave us a number to homeland security to call them and saying we needed to adjust his status before he can get his social security. Oh and adding to the lady, she also stated because we got married that also affects him getting a social security.

So i figured it was the lady and we didn't think to escalate to a supervisor at the time because we were starving and just wanted to get out of there.

But yesterday I figured to go to the driver's license office to at least get him a permit and to test for the knowledgeable part for his driver's license and everything was going good til the lady said that the system which is tied to ICS (i believe that's what she said) did not allow for her to proceed and said that after a 2nd attempt it was sent to thier head office in Austin and that we would later recieve a letter and then he'd be able to apply for the driver's license.

This is all so frustrating.... Has anyone else had this issue and if you did what was done to correct it?

HELP!! I'm getting so frustrated.

If his I-94 says 24th May then that's the date it expires, not 24th March. It sounds as if you got someone from the shallow end of the SSA gene pool.

A K-1 holder does not need an EAD to apply for and receive a social security number, they only need to show their K-1 visa and their I-94 showing a valid K-1 status that does not expire for at least 14 days. Your husband should also take an original, certified copy of his birth certificate, as they may ask to see that too.

I would go back and try again, and if they give you any hassle ask to speak to a supervisor.

and note you got a brain-dead SSA employee.

When you go back, ask directly for a supervisor, and force the SAVE database lookup, and LEARN of the SAVE database lookup results,

before handing over the SS-5 for further processing. If his SAVE record is messed up, you'll learn of it at the SSA office and in real time - but can only fix it at a CBP office.

A K-1 needs only present their unexpired foreign passport (presumably for the entry stamp) or their unexpired I-94.

Their license will likely expire the day their I-94 expires though, since without filing for AoS that will be their last day of legal presence.
