Request for initial evidence?

This topic is for a friend of mine who is stuck with her petition. This is pertaining to her situation.

"I have recently filed for Application to register permanent residence or adjust status(form I-485) for my husband. I received the request for initial evidence stating USCIS needs the following:

-petitioner's income on the federal income tax return does not meet or excel 125% of the poverty guidelines. the petitioner/sponsor lists their current income on form I-864 as an amount to be considered as sufficient; however, no evidence has bee submitted as proof of current income.

please submit:

letter of employment containing dates of employment, nature of job, wages or salary, # of hours worked, paystubs for past 6 months, etc

I had included a letter from my employer stating this already. As for my income, I was just under the poverty guidelines only because I had been on short term disability and was unable to work for a few months. Would showing proof of this help my petition? If not, what do I need to do?

It also states I can use assets to supplement income or obtain a joint sponsor. What would be my best route? any advice would be GREATLY appreciated. Thank you so much."

did u include the last 3yrs of your income tax return? if not maybe they are asking for it!!

my suggestion if u know you cannot make the income poverty guidelines maybe consider looking for co-sponsor before submitting the proof/evidence..just to be in a safe side :thumbs:

If you were under the poverty level requirement, then you do not qualify. You need to use assets to make up the difference or find a joint sponsor. See the I-864 instructions for details about both choices.
