Good day,

I have a couple of questions regarding the I-130 Petition for Alien Relative.

My wife is a LPR and resident in the US. She has filed the I-130 on my behalf. I have a B1/B2 Visa and will be visiting my family in the US soon. My understanding is that when my interview comes up for my Green Card, that it is only done in my country of filing and not in the US.

Is this correct? OR Can I have the interview done in the US?

Also, Its my understanding that the B1/B2 Visa caries a max 6 month stay and then I would have to leave the US and go back to the country of issue.

Is this correct? OR Can I extend my six months while still in the US? I read somewhere that it can be extended with an I-539 FORM.

Once the I-130 is approved the consulate in South Africa will send you instructions on the paperwork that you will need to prepare so you can schedule your interview. The interview is not done in the US. At the end of the process you will receive an immigrant visa - I-551 - which is your green card. With that you will be able to travel to the US and enter the country as a resident.

On a B1/B2 visa you will receive a I-94 at the POE, with the date by which you must leave the US. You can ask for an extension but there are no guarantees it will be approved. Furthermore, regardless of the outcome of your application, your current B1/B2 visa will be canceled at the moment you file the i-539 form which means you will need to apply for a new visa upon your return home.

I am currently in the US on a B1/B2 Visa.

My question are these :

Can I file a I-485 once my case becomes current rather than returning to my home country for the interview?

And

How do i change the BENEFICIARY Address so that all correspondence regarding this case is sent to my address in the US?

My I-130 Petition for Alien Relative has now been approved. My wife is a LPR.



I am currently in the US on a B1/B2 Visa. I am here legally and have not overstayed. I have another 5 months on my B1/B2 visa, then if need be I will leave the US and return again.



My question are these :



1. Can I file a I-485 once my case becomes current rather than returning to my home country for the interview? I expect my priority date to be current in the next month or two going on the VisaBulletins tracking as it is now.



And



2. How do i change the BENEFICIARY Address so that all correspondence regarding this case is sent to my address in the US?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
