I need help.. Preggy and I need to give birth in the Philippines

Hi everyone . I need some information about my plans to travel back to my homeland.

My husband is in the Military , he will be deployed this coming May 2013 , and since I am pregnant with our first baby .

I need to go back to my country so I can be with my family to take care of me while he is gone .

I am planning to stay in the Philippines for a total of 9 months . My question is about my bab's status , can I bring him

back to USA ? I am a conditional green card holder.

can you give me some information as to what I will do to ensure that I can bring my baby with me ?

and also I read that I can go back to USA without a re-entry permit as long as I wont go pass a year outside the United states thats why Im coming back in less than a year.

You would have to file a CRBA 'consular birth abroad' after the baby is born and then get the baby a US passport. You would also need to look into a possible exit visa as well for the baby.

You will save yourself a lot of trouble and headache if you just have the baby in the USA, so its an instant citizen. So you wont be stuck later having to file all this paper work in the philippines

I know going back to PI will grant you Balikbayan status by the PI Government due to you being born in pinas, but staying abroad from the US for more than 6 months can cause issues for your residency and affect your status especially if you are planning on becoming a US Citizen. The time you stay abroad gets counted against your time in the US if I remember correctly but don't quote me on that. If you are planning to give birth in PI then you might want to consider when you should actually go there, especially with you having to secure a US passport for your baby especially if you're husband will be deployed elsewhere.

yes you can bring your baby back to US provided you apply and get issued the CRBA and passport. You know how it is here in PI giving birth. You also need to wait for the NSO copy of the birth cert. It is time consuming. But if there is a need to give birth here in PI, leave US closer to your due date. 6-7 months.

Keep in mind that not all OB-GYN will let you travel by air if you're that far out of the pregnancy especially at least 18 hours flight.

It can be time consuming getting all the paperwork to get your baby's citizenship recognized and a passport. Unfortunately you can't just have the baby and fly back when you want to. If you're planning on 9 months now, you could easily find yourself extend beyond one year. Be safe, get a re-entry permit before you leave for the Philippines. It's costly, but could save you having to reapply for a CR-1/IR-1 later.

I know it would be a lot easier if I would just give birth in the USA . but if ever u already got pregnant u know how hard it is . I only got my husband in the USA no family member . so

if ever my husband is deployed , Im literally stuck at home alone , maybe driving myself tot he hospital in the middle of my contractions?

Congratulations on the pregnancy! If you are still considering giving birth in the US, maybe you can ask Steph (Messybrownhair) how she did it. Her husband was also deployed when she was pregnant.

Anyway I know most of u suggested having a CRBA but the only problem about that is my husband doesn't meet the 5 year requirement of a US citizen. So technically my baby cant assume US citizenship.

I wonder if you guys are familiar with 9 FAM 42.1, it states that I can bring the baby even though I'm just a Permanent Resident as long as the baby is less than

2 years. And also my baby won't need a visa, he just needs travel authority from the US consulate.

9 FAM 42.1

The child born after the issuance of a visa to a parent is not required to have a

visa if the child is:

(1) Born subsequent to issuance of an IV to the accompanying parent within

the validity of the parent’s immigrant visa; or

(2) Born during the permanent resident mother’s temporary visit abroad

provided that (see 9 FAM 42.1 N2):

(a) Admission is within two years of birth; and

(b) Either accompanying parent is applying for readmission upon first

return after the birth of the child.

My wife and I had my son in the philippines, we are going on 8 months trying to get the NSO birthcert. Seriously, have the child in the USA it will save you a lot of trouble and paper work filing
