k1 cancell due to waiting to long

Im the beneficiary ,

my fiancé lives in europe like me .. but she is an american ( because of her father) .

we have been sending the k1 package, but I see california is having a lots of issues

so Im wondering if I can cancell this petition and do something else? like marrying here in europe and after that she goes to the states and live there, and I can come after a couple of weeks or something like that ? do you guys have any advice for my situation ?

You could cancel it and then marry in Europe, but then you would have to file for the CR1. Which will probably take around the same amount of time as the K1 (8/9 months). My advice would be to hold out and wait for your NOA2 otherwise you're back at square one.. :thumbs:

:wacko: No, same issues, except you will start all over again. The K1 and the CR1 take about the same amount of time depending on a variety of factors.

so you say that the cr 1 takes the same amount of time ?? so I should just wait for my K1 thats better right ;)

Although CSC has had a significant slowdown, you are already several months into this process. At this point I think it more is a question of your timeline and mutual wants and needs. If you decide to just go ahead and get married, you will have to then file for a CR1. The bad news with this is it takes about the same amount of time for a CR1 as it does with a K1. Also, you need to be in your home country for the medical and interview. Just a couple of things for you to think about. Also, you will not be able to work in the US until your CR1 is approved.

Would you qualify for Direct Consular Filing / is it available where you live? If so, it would probably be faster to cancel the K1, get married where you live, and apply for a Spousal Visa through DCF. See here http://www.visajourney.com/content/compare#dcf. Good luck.

the problem is, look what the site says

"U.S. consulates will typically only do this for US citizens who are Legal Residents of the country (typically for at least six months)"

but she lives in europe like me .. so this wont work for us I guess

On the contrary I'd say this is exactly your case, as it sounds like your fiancee is a legal resident of the European country where you live AND is an American citizen. I don't know if DCF is available where you guys live though. On the contrary I'd say this is exactly your case, as it sounds like your fiancee is a legal resident of the European country where you live AND is an American citizen. I don't know if DCF is available where you guys live though. I'm not an expert on the matter, try posting further questions in the DCF forum: http://www.visajourney.com/forums/forum/82-direct-consular-filing-dcf-general-discussion/

Correct answer. If she is living in that country and has been for 6 months or more you can apply for the CR-1 through DCF (direct consulate filing) and get your green card before you leave with your wife.

Check with the US consulate in the country where you are. If this is not possible, then getting married and doing the CR-1 by petition is another option but it will take longer than the K-1 and you have to start over.
