I've been reading the AOS guidelines and the truth is I am a little confused. I've been following the AOS forum and found one that stated before a K-1 holder applies for AOS they have to apply for a social security number. I just wanted to know if that was true bc when I called USCIS I was told my fiance cannot apply until we are married. I have been filling out these forms for AOS.

Does he receive a social security number with one of those forms or do I need to fill something else out?

I did not file for my SSN until I received my WOrk permit. I waited that long cause I wanted to have my married on my SSN. Your fiance can apply for his/her SSN even if you are not married yet, BUT you should with a frame of 3 weeks at least BEFORE the i94 expires. Otherwise you will have to wait until he/she receive the EAD

First off, the SSA workers do not know what they are talking about most of the time. You do not have to be married to file for the SSN. A K-1 holder is eligible to file for an SSN after entering the US. You usually wait 10-14 days before going to the SSA to apply to make sure you are in the system database. Sometimes you have to let them know their own jobs and show them proof you are eligible to get the SSN. You can apply for the SSN up to 2 weeks before the I-94 expires. After that, you will need to wait for the EAD. SSN has nothing to do with marriage. The SSA workers really should stop trying to dabble in immigration procedures when they do not even know their own jobs.

All that being said, you do not need the SSN to apply for AOS. You may need it for banks accounts, insurance, license/state ID, etc., so you should still try and get it as soon as possible.

By the way, I think you meant the I-131 form for AP.

Oh yeah I meant the I-131 :D Thank you so much! Is there any paperwork that I can bring in and be like see a K-1 visa holder can have a SSN? Bc I know the SS office near me has really rude workers. My father went there to look into retiring and rude cannot even begin to describe the ppl who were supposed to help him. We want to apply as soon as possible bc we want him to open up a bank account soon.
