Timeline

Called USCIS help line number from the RFE

That's crazy. USCIS level 2 told me this morning in regard to the RFE that most recent tax year is 2012..

It's crazy they said even if we were in jan 2013 I would still have to file and show my return for 2012, not 2011

I'll have it April 5th at earliest...

That delays my whole AOS for close to a month..

Glad though I got it near filing taxes and not in Jan!!

Said I don't need to wait for transcript

So I send in the RFE all the tax papers I'm sending the government right?

Yes. File your 2012 taxes and send in a complete copy of the return including all forms, schedules, and W-2s, as I posted above earlier in this thread.

I would go ahead and file your 2012 taxes and respond to the RFE with a complete copy of your 2012 tax return that includes all forms, schedules and W-2s. You sent the 2012 W-2. I believe they are wanting a tax return to go with it and not just a W-2.

Might be an obvious one, but it seems all they want is the Federal return, and the instructions they point to are for form I-864A which say "do not submit copies of your state income tax return" and later mentions also not to send foreign government (Canada) taxes also. So I don't exactly send my whole cross-border tax package with the RFE, but just handpick what concerns the US Federal gov taxes? Thanks!!

State taxes are something filed separately, and they only concern themselves with the Federal taxes. They do not want taxes you filed in another country, as those do not count, and do not concern them either. If you had to file something such as a foreign exemption form along with your US Federal taxes, then I would include a copy of that. Just include everything that was part of filing your 2012 taxes here in the US, Everything that would be needed if you had to snail mail in all the forms to the IRS in order to file.

Since my accountant completed my US taxes today (Canada next..), I got all the 31 pages (including California), and they will all be e-filed.

I was sent those 31 pages with "Client Copy" watermark on all of them, can I use that or need it without watermark?

Here are the Federal return files I'm planning to send, anything I should not include (ie. worksheets, FBAR foreign accounts, consents for e-filing?)
