I have been reading abt misrepresentation and whether is material or not material. Let say I married my wife and She applied for tourist visa(nonimmigrant) indicating she is married to me and coming to spend holidays with me but was refused because the consular officer feels she dont qualify for nonimmigrant visa and thus i should file an immigrant petition for her since am a US citizen and we are married together.

So my question is since my wife was denied the visa for this known facts. Can the embassy later turn around and say she misrepresented herself on the previous visa application being whatever when she goes for her immigrant visa interview (CR-1)? i heard abt these stories abt misrepresentation and want to be aware abt material misrepresentation and immaterial misrepresentation. Am not saying she misrepresented herself bcos she didnt and wasnt refused for misrepresentation but refused for the fact that she is not anonimmigrant bcos she has a US citizen spouse. Hopes my question is understood and thanks quys for making vj informative

You won't have a problem. Misrep involves lying / concealling fact that would change the decision in order to try to get a visa. Your wife didn't do that
