Hi everyone,

Early last year I was approved with fiance visa and flew to USA to be married supposed to my fiance. But just after 3 weeks I found many inconsistency and lies about his true situation in life. He is totally dependent to his Mom --lives with his Mom for many years, his Mom who decides for him, his mother cooked the food for him, does not know anything in the household even folding and washing his own clothes and underwear and it was his Mom who decides for him and even for our wedding preparation. He was divorced twice and I guess no wonder his second wife left him because they are living with his mother and he cannot stand on his own. He was 49 years old already but seem like just a teenager. He said it was long time ago that he had been a member of a "Gang" but when I was there he is meeting his gangsters' friends. He lives in Pico Rivera, California, so I am in one of the dangerous community in California. That is why I decided to go back home than to marry him and had a miserable life. So I went home before the 90 days expires. Now I had a new relationship. He came here in Philippines last month for us to see each other, know each other better and meet my family and friends. Then we liked each other to go further in our relationship. But we never talked about marriage yet. Then he want me to meet his family also and see if I like them or know him more better with his family. So in this reason he want me to visit USA for 2 to 3 weeks just to meet all his family and see his church and church mates. Which is a better idea for me also before getting into marriage with him. Though he want us to settle down here in Philippines if things will work out with us. The thing is, I am still single at age of 36 and I had never been married. I used to work for 8 years in one of the multinational company before, but I do my own business now. So with this reason, is it possible for a single woman like me to apply for a tourist visa and who had a previous fiance visa before but the relationship did not work out? I had been to HongKong and Thailand before, then in USA and got home before my 90 days expires.

I might be wrong here, but it seems to me that you shouldn't have any problem getting a tourist visa. You applied for a fiance visa and when it didn't work out you returned home again within the 90 day limit. It will be brought up in the interview and explain it just as you did here. You have also been to the states before with a tourist visa and returned within your limit. Its my opinion that the consular will see you have had ample opportunity to migrate with your fiance visa and didn't.

I guess the only thing that they might worry about is that you are using this visit to meet another man, but your past proves that you are not a risk of migrating. Just my opinion but I would give you the visa :)

You can certainly apply, though the reason will be seen as suspicious (they may think you will marry and stay in the USA). The fact that you left before your K1 90 days were up and have a good business in the USA are positives. I think it's worth a shot, all you have to loose is the application fee.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
