IMBRA is not suppose to affect I-129F petitions for alien spouse (K-3)

May be that it technically was not supposed to affect them but it did. All I-129F K3 applicants after March 6 were also required to provide IMBRA information on an RFE. This may mean a waiver will be necessary. You'd have to do some research and consult an attorney to be sure.

The "brief description" would be the waiver request, assuming that one is needed, with the inclusion of 4 simple words.

Interesting topic. My I-129f petition was also denied for not seeing my SO within the two year mark so instead we got married. Now I'm waiting for the marriage cert but once I recv it I will file the I-130. On the I-130 & I-129F it asked if you have ever filed for this alien or any other alien before. Well for both I will attached a brief description of the end result along w/the denial letter. Do I still need to send in a waiver? Or should this be enough?

I shoud qualified my statement further to have said the IMBRA filing limitation does not affect K-3's. The other IMBRA items in fact do......

Our Visa has been denied because i have not been to Hong Kong in over 2 years. I took a chance and of course it didn't work, so now we have to start all over again. I will have to plan a trip to Hong Kong, take more pictures and file for visa from scratch. let this be a lesson to you folks, make sure you follow all instructions and guidelines, don't be a dummy like me and try to cut corners.

So sorry.

As far as USCIS is concerned you need a waiver if you file anything within the past two years. I filed an I-130 about two years ago, never filed an I-129F, K-1 nor K-3, and was told I have to file a waiver.
