was married before divorced finalized

Hello VJs:

I am the USC and I am petitioning for my wife.

Here is my delimma:

While I was in legal Spearation from my ex wife ( married her when I was Student on F1 visa. she is UCS,got my green card, citizenship thru her. we have a child and we were married for 9 years) , I met my wife and we dated for 1 year than get married in my country. one year later, my divorced was finalized and I had off course to remarry my current wife in order for the marriage to be legal in the US. So, the date on the new act of marriage is 6 months after the date on the divorce decree.

my wfie will have her interview in May and was wondering if any can provide anu help if we ever she was asked to explain at the interview?

I'm not a lawyer, but my suggestion would be to talk to one. I don't say that to most people applying, but I believe that your second marriage may not be legal in the US because you weren't yet divorced. You may have to remarry your current spouse to make it legal for the USA.

Like I said, I'm no lawyer, so I don't know any of this for certain, but I'd recommend getting at least one good legal opinion about this as it could cause a denial.

February 6, 2013 - USPS Receipt/Delivered I-129F April 28, 2014 - Received Acceptance NOA1 hard copies for AOS and EAD May 13, 2016 - Walk in Biometrics Completed

February 8, 2013 - NOA1 Notice Date May 12, 2014 - Biometrics Appointment Done September 27, 2016 - ROC Approved (Checked status via website w/receipt #)

February 11, 2013 - Bank shows check cashed today May 15, 2014 - Interview Schedule Letter (received May 17, 2014) October 6, 2016 - Card Arrived

February 11, 2013 - E-Mail Notification of Case Acceptance and June 5, 2014 - Interview Scheduled at Local office 8:15 a.m.

Case Number (Routed to California Service Center) June 11, 2014 - USCIS Status updated to show Greencard in the mail

February 12, 2013 - E Mail Notification of Alien Registration Number Change w/USPS tracking showing it scheduled to arrive

February 15, 2013 - Hard Copy NOA1 received June 14, 2014

June 5, 2013 - Email notice of RFE June 13, 2014 - GreenCard arrived

June 6, 2013 - RFE postmarked

June 10, 2013 - RFE arrived in the mail

June 11, 2013 - RFE mailed back Express USPS

Ah ok. I misread your original post. Since most of my knowledge is based on studying up on K-1 visa's, I'll let someone with a better idea of the Marriage issues answer for you.

The biggest issue I see would be that you were dating, than married someone while legally separated. Just be sure the divorce decree you submit has that highlighted that you were legally separated. Otherwise it just looks like a man married trolling for women.

You getting remarried to a CO I would think shows your love commitment and bonafide of relationship.

But still consult a lawyer to get all your ducks in a row.

Yup, actually the divorce decree spelled that out. I was legally separated from my ex when I met my wife and married her.

I know it is still illegal that's what I remarry her to rectify the whole situation.

Now when did you actually file? When you first married her or after the divorce was finalized and you remarried your wife.
