Well, we're soon approaching the 11th month mark of our NOA1 for AOS. Putting in a service request gave us an answer of "we'll get to it when we get to it" and so far contacting both a congressman and senator did nothing, as we've not heard back from either of them. It's frustrating that no one will look into this!

This delay in getting his AOS is pushing back all of the next processes afterwards, ROC.... Citizenship. I don't think that's really fair.

I'm sure that we're not the only ones waiting this long, but not sure what else to do, but wait?

Looks like you may need to extend your Employment Authorization Document (EAD), Form I-765.

2011-10-24: I-129F Sent from Doral, FL to lock box, Dallas, TX
2011-10-31: Received USCIS NOA1 Letter
2012-04-02 (8:30AM): I-129F Approved. NO RFE!
2012-04-06: Received USCIS NOA2 Letter
2012-06-06: Interview / Approved!!!

2012-11-05: I-765 - Approved - Employment Authorization Card production ordered
2012-11-09: I-765 - Employment Authorization Card mailed
2012-11-13: I-765 - Employment Authorization Card received

2013-07-05 (11:45AM): AOS Approved. NO RFE. NO Interview.

2013-07-11: Green Card mailed.

2013-07-12: Received I-797, NOA, Welcome to the USA

2013-07-15: Green Card received.

2016-04-06: Earliest Accepted ROC Filing Date

AOS Approved 7/5/2013:
308 days (10 months & 8 days) since AOS package was sent
302 days (10 months & 2 days) since NOA1
275 days (9 months & 5 days) since Biometrics taken

Keep pushing...the squeaky wheel gets the grease. Go in person to your rep/senator's office and talk to the immigration liasion. I have found it really helps for them to see you as a real person rather than a random name on a piece of paper. I would bug the heck out of everybody I could until someone listened.

Don't know much about how it works, but you may want to consider contacting the USCIS Ombudsman. Google it here and you will find threads that talk about how to do it.

I have been thinking about using the Ombudsman service also. Has anyone used this service and what did you think of it? To the OP, I totally feel your pain. Me and my Wife are coming up on the 10 month mark. The service requests and contacting our congressman and senator has only told us we have to keep waiting with no time frames. This is why I am curious if someone is really way over the processing time frames that this Ombudsman service might help. Let me know what you think. Thanks.

Looks like you may need to extend your Employment Authorization Document (EAD), Form I-765.

I have the paperwork started on doing that. There is a question on the form that asks what his "Current immigration status" is (question #15 on the form). I'm not really sure what to put in there... Pending green card applicant is what I have for now, but should it be K-1 visa holder? Or legal alien?

Also, we didn't send in for the AP at first, so I'm thinking about sending in for that too right away.

I really have no idea how an Ombudsman works! Where do you even get one? lol I feel like I'm lost in that regards since I didn't think I would ever need to get in touch with one!

We just received an email today that our green card has gone into production. We filed back in May of 2012 and we had an RFE dated January 2013. Hopefully yours will be in production soon. I know it can be really frustrating, but hang in there.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes.

I wonder if the USCIS takes volunteer workers? Perhaps I could exchange work time for expediting my app.

Haha I wish!!! Though, I suppose we'd be biased for our own petitions :dance:
