Can I Still Go for the K3?

I filed the K3 for my husband about 9 months after I filed the i130. They both got approved in the same week but I decided to go ahead with the i130.

We already got case complete and are awaiting an interview which is months and months away because the consulate in Yemen is backlogged. From seeing other people's journey, the U.S. embassy in Yemen seems to be giving interviews for K3's faster than i130.

Can I still go the K3 route?

No, the K3 path would have been closed by now.

I am curious though, where did you see these people with K3s getting interviews? I have seen maybe two K3s in the last couple of years, globally. Are you sure they don't have K1s?

For sure they are K-1's. I don't know what the interview scheduling discrepancy is between Non-Immigrant Visas and Immigrant Visas at Sanaa. Maybe they are understaffed in the IV unit? Who knows. I hope they get to you soon H93 (F) .

In regards with the K3 visa. I was curious about the K3 visa so I emailed the US Embassy in Malaysia. Here is the response:

We hardly issue K-3 now since CR-1 comes before K-3.

Thanks for your response. I know 2 people who went the K3 route and got an interview 6 months after case complete, they're not on VisaJourney.

Thanks, same to you. =D

Really? You should contact NVC then or DOS. But they may tell you the same thing as us because it sounds like K-3's are totally at the mercy of the individual embassies. Do you know if your case is at the Embassy yet or still with NVC?

is possible to go the K-3 route, but you must call NVC and inquire what is the status of the I-129F, by the casefile receipt # from uscis.

IF the I-129F was not administratively closed already, you have some chance.

Another question, when happens to the i130 petition if I decide to go ahead with the 129f?

Can I request them to open the 129f back and still have the i130 petition to see whichever one gets me the faster interview?

My case is still with NVC. =/
