I have had all my I-864 appliation package completed for quite some time now waiting for petition approval( March 4th) and NVC case number( call everyday, they said they received on March 8th but it is not in the system yet for case #)

I, along with several coworkers were laid off on March 11th from my company. Now I am unemployed.

Should I redo my application package? Or just leave it as is and then if they ask later on let them know I became unemployed after I completed the package.

Hi,

You need to have a co-sponsor, use assets to meet the poverty line or find another job. I would not use that I-864, since it's no longer current annual income. Sending that I-864 is a big No No.

u shouldn't redo it, i dont know why others are asking u to, u didnt lie on the forms, at the point filing that was the case, people do lose their jobs, they dont refile. for example when filing it says u must have met within 2 years AT THE POINT OF FILING. it's at the point of filing.

if u have not shipped out your application, then u need to redo it, but if u already have it waiting its adjudication, i dont even think u can refile, the one already sent needs to be retracted or nullified or allowed to expire.

what u need to do now is get another job by the time of the interview, even as a waiter, then u get a co-sponsor.

u can google for a free phone call consultation with an immigration lawyer and ask this, there are a lot online.

This sucks beyond belief. If they wouldnt have taken forever to approve the petition this wouldnt be an issue. Now I finally get the petition approved and I get laid off a week later

seriously, u do not need to re-petition, just get a job as soon as possible and get a co-sponsor as well for your partner can show at the interview that u can take care of him/her.

u didnt lie on the forms, u wrote the truth, and the date of filing is on the forms.

i have seen some who still didnt have a job at the time of the interview and the beneficiary was told the visa approval is being put on hold till the USC shows he can take care of the beneficiary, and to present the necessary documents once they have proof, and have the visas issued right away.

my partner didnt have a job when she petitioned, the important thing is she has one before my interview, about a month before the interview, so that one can show pay-stubs as proof that the USC has been taking salary.

just continue with the process through to the interview, while u look for a job, getting a job may be difficult, but u can look for a low paid job, as long as it gets u employed, even if a store or restaurant or hotel, but this low pay would mean u wont meet the minimum required amount, so u get a co-sponsor as well ...finito.

He doesn't NEED to redo the petition He needs to redo the I-864. He cannot lie and say he has a job, when he does not have a job now.

aaaaahhhhhhh ....u are totally right, i thought poster was talking about redoing the whole application and having to wait 8 months again ...redoing the affidavit of support isn't a big deal ...the hardest part of the application has been passed, the 8month wait, u are almost at the finish line ...finish hard.

@mikeandclara, as i said before, just get a job (almost anything would do for now) and a co-sponsor and fill the affidavit of support with the new info.
