Question about canceling 864 and AOS

If your spouse leaves and goes back to home country and pursues divorce before AOS interview but after AOS petition is filed, is it possible to cancel 864 and AOS? What is the procedure? Will any refund for AOS fees be issued?

The non-USC abandoned AOS by leaving in the middle of it. Did he/she have a valid travel document (i131) when they left? If yes, then write a letter to USCIS to withdraw the I864 based on the non-USC leaving/seeking divorce. Attach a copy of the NOA1, write the case number on your letter as well.

Either make an info-pass appointment to hand over your documents or mail them (with tracking).

No refund on any money orders/checks already submitted to USCIS. If it's been cashed, then no way back, money-wise.

You need to make an infopass appointment, and write a letter to USCIS requesting cancellation of I-864. Call USCIS and speak to Tier 2 sup. AOS cannot be cancelled by you, as you are not the applicant.

1. copy of the receipt , showing the receipt number

2. letter of withdrawal for the I-864

3. your ID.
