My husband was given a K1 Visa last July, and we were married in the US in August. We applied for his Adjustment of Status, but he decided to move back to Norway before his official interview. Now we are both in Norway, but I am facing the possibility of having to return to the US. If I have to return, we would want to file for a IR-1 / CR-1 Visa. Would there be any issues because he left before his Adjustment of Status was official? Do we have to start the process from the beginning, or is there anything we can do because we filed before?

We are expecting our first child in September, and want to try to be together for it. I'm just not sure how realistic that is.

A CR1 will take about a year from filing date. I am not sure if you are covered by a USCIS field office, someone will verify that to see if a direct processing is available. If you file from there before you move there seems to be a shorter timeline for those USC's who use a foreign address even in the CR1 line but you are still not going to be together in time for the birth. With a child you will also need a job that covers 3 heads.

This will not be over quickly. You will not enjoy this.

Will it be okay for me to file from here with a foreign address if it is not permanent, and if I have to return to the US?

I am a visitor in the process of applying for residency. I will go back to the US in the case that I am denied.

Before you go filing for a CR1 you need to first find out the status of your Adjustment of Status. You just did all this and the service centers have been very slow.

When you say "he decided to move back to Norway before his official interview". What do you mean? Were you scheduled to come in? Not all Adjustment of Status get interviews.

How was he able to fly out? Did you apply for advance parole before you left because thats another issue also.

Have you checked online for you status?

You need to call USCIS before you do anything else.
