Hi all, I wasn't here for a while cause we didn't proceed with the papers for personal reasons. This Jan we sent them and yesterday my husband received a letter stating that I will be contacted within 30 days for the interview in local consulate. I thought that somewhere in between we had to send Affidavit of Support. Am I wrong? Should he fill it out and mail it to me so I can take it consulate? Guideline is s vague, I cannot understand what to do and suddenly its so close I am freaking out. please advise! Tina&Jay

Please fill in your timeline, we will be able to help you better that way.

Is your husband in the USA or with you abroad? If abroad and you filed directly with the US embassy locally, many US embassies will jut ask you to bring the I-864 with you to interview. If in the USA/ your husband sent the petition to a lockbox, then the I-864 and proof to go with it are usually sent at NVC stage. Maybe you sent one before>? If so, you can submit an updated one at interview.

I tried to do the timeline but its a bit confusing. Plus, not much to write. Jan 2013 Petition sent to Chicago lock box. Petitioner in US, I am in Georgia. In March 2013 petitioner received letter stating: your case approved, documents will be forwarded to local consulate and whom you have petitioned for will be contacted withing 30 days. That's why I am lost with Affidavit. I guess because I am not in US, he has to send it to me so I can present it at the consulate. Thanks. :) I'm panicking.

Your husband petitioned you this January and you are already in line for an interview? That seems extremely fast and unusual, probably the fastest recent timeline I have seen. Did you expedite? Where is the "we didn't proceed with the papers" you talked about?

I am confused myself. We got married in 2010. That's what I meant, we didn't apply till last year (2012), November however papers were returned to us, because I accidentally left the Place of Birth blank. We send everything again in January 2013. Within 10 days he got text message: application received. We logically were expecting request of affidavit of support sometime in May. However, letter cam yesterday stating: Application Approved, documents forwarded and you will be contacted by local embassy within 30 days for the interview. We didn't do anything extra ordinary. I guess I will call the embassy here. Probably I need to have affidavit with me at the interview.

Looks like you were just sent the wrong letter. I have seen that wording and its for a K1. Because most cases are going to local offices they have been very bad with sending wrong approval letters.

So please call USCIS tomorrow to verify.

Your next step will be NVC come to the NVC filers thread and read Post #1 and #2 to get ready. You have some things to get together.

Hi all, an update. The letter was not a mistake. Afterwards, we were required to register an Agent, what we did. Now, I am required to pay visa application fee online - $230.00. My husband has paid about 500 before, for the processing. I am still confused:

1)Will they ever ask for affidavit of support?

2)is this 230 my visa fee and I won't need to pay it here?

3)will it be any help that after i move, i am keeping a functioning business here?

4)if my friend, who owns a business in US provides a letter (no idea how it should look like) that he can employ me, will that be of any help?

5)when do I need a medical check?

sorry for so many questions, just in my case it's all weird. :) j/k I know this is common.

Your spouse will be contacted by the National Visa Center in the USA first. There are three more packages of paperwork to submit and two more fees to pay. The affidavit of support is the second package.

The petitioner received a letter indicating the "petition" was approved, not the "case was approved" or that you were ready for an interview. Read that letter carefully again. Whatever it says, your I-130 will go to NVC before it goes to the Embassy or Consulate.

NO honestly your case IS weird.

Have you contacted the NVC? Is your case there? Do you have a file number? The Affidavit of Support is from the petitioner, your husband, not you. Who did you husband pay $500 to? The USCIS petition is $420. But you've said that is approved? Are you using a lawyer?

Please read this:

Now for your questions:

1) yes

2) this fee is paid to the NVC, not at the consulate

3) no affect

4) nope, it's up to the petitioner to be able to support the beneficiary but it's great you can get a job asap

5) before the interview. You normally can set one up after you receive an interview date.

No, this case is normal, not weird. The OP is just using round numbers and incorrect terminology based on a misunderstanding of what would happen. The normal procedure is explained in the guides and wiki.

Ah that would make a great deal more sense.

What is OP? Please, clear. But, logically that'd be me.. and kinda if it is, it would be nicer to use my name. :)

As for the rest, thanks for all the comments. Yes, probably it was 420, I remembered 480, that why I said about 500. However, I knew that after registering an agent, Petitioner should file Affidavit of Support. NVC send me a letter asking for: visa application fee - $230.00 Paid online. Only after that we can proceed.

My case is there and I have number, all good. I guess I will just pay 230 and then wait for what will happen.

Thanks

PS - not using a lawyer. :)

Okay way back in March I attached the NVC filers thread to you and others have attached the link also, Have you even gone there?

You can pay the $230 fee all you want and nothing is going to happen to your case until you send in your Affidavit of support package and your DS-230 package. You need to be reading up on that.

Do you have your documents together already. Knwo all the forms you need.?
