Hello VJers,

Had a few questions on filing the forms. Please bear with me ..

on form I-864 : My wife doesn't make enough money, so we're using my brother-in-law as a joint sponsor to qualify. So here's my question, can he send only his W2 and most recent tax return to meet the requirement ? He explained to me that his tax returns are "quite the stack", and that sending all three most recent tax returns will be as thick as my actual AOS application. So I was wondering if JUST his most recent tax return & W2's will be fine with USCIS instead of ALL 3 recent years ? I mean he made enough to cover us so it should be fine right ?

on forms I-485 & I-765 : I came in on an F1 and THEN fell out of status. Both forms ask for "Current USCIS Status". Will i be lieing if I wrote F-1 or Student ? I mean what else can I put .. "Out of Status Student" ? I just don't want to be faulted for any misrepresentation. What would you suggest ?

on form I-130 : My wife is here debating with me that we don't have to fill out the forms in ALL CAPS, as long as what is written is legible & clear. We're ready to send this stuff in come Monday/Tuesday & were wondering if anyone's forms have been denied/rejected for not being written in caps ? How big of a deal is that ? Just trying to play it safe here. (we dont have access to computer of ours by the way, and just felt safer hand-filling it than using a friends laptop)

Applied for Post-Graduation Work Permit (OPT) - Jan, 23rd 2012
Work Permit (OPT) Denied for "late submission into SEVIS system" - Received Denial Letter April 3rd, 2012
Fell out of status ...:/
Married - September 10th, 2012
Mailed I-485/I-130/I-765 Packet - April 1st, 2013
Arrived at Chicago Lockbox - April 3rd, 2013
Received E-mail Acceptance Confirmation - April 10th, 2013
NOA1 - April 15th, 2013
Biometrics Appointment - Received notice on April 22nd. Appointment scheduled for May 6th, 2013

Received actual interview letter - May 17th for June 21st

Interview, June 21st. - No decision made. IO said we should expect to hear back from him in 2 - 3 weeks, that we can expect a visit or phone call just to verify. Interview started out fine, but IO didn't seem to like our living situation with a friend. We are hoping for the best ....

Aug 2nd - 6 weeks later. Still no word :/... Please send prayers

Moved on Aug 16th to our own place smile.png, after living with a friend for the longest.

Missed Officers Home Visit - October 25th

Officers visit Wife's Auntie's House - Nov 8th

Officers Interview Friend who wrote affidavit in app ??- Dec 20th

It only says the most recent year is required. A tax return transcript would be more convenient than a tax return and W2's and all that paperwork.

Something like "F-1, out of status" would be fine.

The family name on I-130 is the only field I know that needs to be in all caps.

Tax return transcripts are what's preferred both by NVC and most consulates. They are free to order from the IRS. Here's the link:
