The Problem with UBCs and How it Will be Fixed

Uniform Background Checks (UBCs) are the only remaining gun control measure which has not been shot down (pardon the intended pun) before making it out of Senate committee. There are no gun control measures in the House worth mentioning. The proposed bill is full of problems...intended that way. What are they? What is the controversy and how will we fix it?

1. The bill requires background checks for private sales of firearms and requires private sellers to use the service of a dealer to do this. Of course this imposes fees and delays on private sales and could curtail or eliminate private sales at gun shows (dealers already do background checks at gun shows). The INTENT of the bill is not to provide background checks but to hinder sales of firearms and make them impractical on short notice. A de facto waiting period.

2. The bill requires the seller to prove he is the legal owner of the firearm. So, I have a Winchester M1895 rifle my Grandfather purchased USED in 1924. It was passed down to me when he died in 1988. How do I prove that I am the legal owner of that firearm if I wish to sell it? Current law requires owners to report stolen firearms and one could just do a check of stolen guns and if it is not on that list it is OK...right? Wrong. The bill does not allow that and places the burden on the seller to document the firearm is legally his. Few states have registration of firearms, and NO we do not want that, but that is where this goes to. Such a provision, if passed, would virtually mandate a follow on National registration of firearms. So, again, we see that the intent of this law is not crime control but a way to get into people's privacy and rights. Who knew?

How it will be fixed.

Amendments slated to be added in either the Senate or House floor debate will strip out the provision requiring the seller to provide proof the firearm is his. Enough records are required to be kept by the buyer and seller that if a gun turns up stolen it can be traced. It is simply not practical or tenable to do so otherwise, but that was the idea. Dems will not put up much fight on this. They can't. It is patently ridiculous and they cannot risk coming up empty handed on gun control for something so stupid.

As for background checks, an amendment will be introduced which funds a nationwide internet based background check system which can be accessed by anyone to do background checks on THEMSELVES by creating an account. Using an identifier number, (Drivers License or State ID number is preferable to SS number)potential buyers can perform their own background check, valid for 5 days just like current dealer background checks, print them and take them to gun shows or to private sales themselves and hand a copy over to the seller. The seller keeps that paper for 10 years. There is no information about the GUN(s) on that paper, just as there is no information about the GUN(s) on current dealer background checks. The point is to prevent criminals from buying guns, it matters not which gun is bought, only that the person buying it passes criminal background checks. When the system is in place, and a deadline date will be provided just as it was for the initial system in 1993, the law will be implemented. The Dems will fight this, but not too much. If it fails to be added in the Senate, it WILL be added in the House where it has the needed support. It IS providing for UBCs and they can still claim victory. Technology is grand!

Expect also to see an amendment providing for reciprocity of concealed carry laws nationwide requiring states to honor concealed carry licenses just as they honor drivers licenses for non-residents for temporary visits. This amendment will be added in the House where it has already been passed as a stand alone bill. Dems will fight it and this may be a poison pill that kills the whole thing when it goes back to the Senate/House joint committee. The entire bill may be killed by the people that started this. Again, Dems already look stupid and impotent and at some point they are going to have to open wide and have it stuffed down their throat or they will get nothing. Nada, zip. You will not hear much about this provision unless you are a C-Span junkie. The mainstream media will not cover it. Dems will be counting on that

Thus changed, the UBC bill will be what the NRA has long pushed for, the improvement and expansion of the current system, nationwide recognition of concealed carry and effective security measures for schools (funny how that gets left out, isn't it?) We WILL have what Wayne LaPierre suggested in his news conference a few days after this mess started. OR, there will be nothing. And y'all laughed at Wayne, remember?

It will be another 20 years before they try this again.

THAT's how you drive a car!

#2 would be impossible in many cases. I have guns I purchased new many years ago and don't have a receipt to prove it.

Of course. And the people writing this bill, who want to infringe on our individual rights as much as possible, KNOW this. It is their intent to complicate the process to the point that either gun shows are halted or people do not make any private OR people become criminals to sell firearms they have held for years. It will be stripped out of the bill on the floor.

To the "a magazine is the same as a clip" idiots, this proposal sounds "reasonable" because, yeah, it will prevent people from selling stolen firearms. In the same way that license plates on cars prevent car theft. A simple bill of sale with names and addresses matching ID is all that is needed. The seller keeps the background check, the buyer keeps the bill of sale

These fascists always take it as far as possible. I mean WHO could be against banning "cop killer" bullets or "armor piercing ammunition" ???? Only NRA wackos, right? Sop why would it NOT pass? Because the bill defined "armor piercing ammunition" as any ammunition which could penetrate 15 layers of Kevlar. That would be ANY centerfire rifle cartridge commonly used for deer hunting and match competition. Your .243 ammunition would be banned, your .30-30 would be banned. The .30-06 with deer loads...oh holy #######! that one will shoot through 3 vests and a brick garage. Physics. Who would need ammo lie that???????????? For deer hunting???????? Sure. In order to get a bullet to perform at the ranges needed for hunting deer it needs to have sufficient velocity, sectional density and ballistic coefficient to get there without shedding all its initial energy. The side effect of that is it penetrates just about anything that is not thick steel plate and it even makes huge divits in thick steel plate. Hunting ammunition since the late 1880s can easily penetrate modern Kevlar "bullet proof vests"

Was it a mistake? NO. Who supported it? Idiots and fascists. Fortunately they are still a minority.

These attempts to strip our individual rights get foisted off on us as "protections" and "reasonable"

In the most recent bukkake we saw attempts to ban all handguns, register all firearms, ban any bullet containing lead, among other nonsense...all foisted off as "reasonable"

In this forum we saw the idiots and fascists post every article for every time someone shot themselves in the foot and claimed it was a reason to...(fill in the blank) All those people have crawled back under their rocks now after making a huge contribution to NRAs power and funding and selling a lot guns. Century Int'l Arms in Fairfax, VT, the maker of the "USA-AK" among other rifles is hiring, they have had radio and newspaper ads for WEEKS for assemblers, machinists, engineers, marketing people. If anyone wants to live the FREE life in Vermont, y'all can come up and make guns! I heard Gabby Giffords is on the waiting list to buy one.

Oh yeah, and a big "Howdy!" to Gabby and her husband...fellow "assault rifle" owners! You are always welcome!
