Hi All,

I need your help on behalf of my cousin. My cousin’s husband filed for her, she was approved and got her visa to join her husband in the United States. After some months she got pregnant , when her baby was born she sent for her mother who was in Nigeria, her mother was given a 6 months visa to come and help my cousin with her new born baby. Unfortunately my cousin’s mother over stayed her 6 months visa she was still in the U S my cousin gave birth to the second child. My cousin’s mother stayed in the U S for over 4 years, she now decided she was going back to Nigeria, my cousin told her to wait for her to get her citizenship but she insisted she wants to go back to Nigeria. So they let her go, now my cousin filed for the mother and she was approved by the USCIS and the NVC , but when the U S Embassy Lagos invited her for interview, they asked her how long did she stay in the U S when she went for visiting she said she does not know, but they then told her how long she spent. Then they asked her why she over stayed and she said her daughter that is my cousin was very sick and was admitted into the hospital. Actually my cousin’s mother did not tell the truth about why she over stayed. So the U S Emabssy Lagos Nigeria told her to go and get a waiver, I know if she has to go get a waiver she needs to prove that my cousin was sick and was in the hospital and that means she has to provide doctors report. So now the U S Embassy told her she has a 10yrs banned from the U S except she gets a waiver. Now my cousin is very worried she just want to know what next she has to do to bring her mother to the U S.

She might also have a ban for misrepresentation.

Does she have a qualifying relative to file a waiver, Spouse, Parent, who is a US Citizen or LPR?

If they find out she lied to the consular officers, she could get a lifetime ban for misrepresentation. She made her situation a lot more complicated than it had to be by lying.

USC who lived in Manabí, Ecuador with hubby from 2009 - 2013. Hubby became a naturalized American citizen in August 2016. Currently living together in northern Virginia.

Without a qualifying relative ( children don't get to file waivers for parents ) the mother can't do much other than sit out the ban of 10 years and hope at that point her lies don't get her a misrepresentation and a lifetime ban.

This will not be over quickly. You will not enjoy this.
