hello everyone, i really need all your help,ideas,opinion and suggestions.i am really confused what to do. my husband filed I 130 at Manila.

now we received a packet 3 including our case number. my questions are:

1. since my husband is staying with me here in the Philippines, what papers or documents we can show to meet the domicile

requirements of my husband? by the way he's a hundred percent disabled vet.

since,hes a disabled vet he's pension is exempted from tax..so we can't show any papers about tax.

2.he dont have any properties in the US but he receives money from the VA,is this enough?

.he has an unexpired drivers license in Florida but thats all we got.

pls pls help me,,enlightened up my mind..thanks a lot!

for 1, he will likely need the tax rules on why he does not have to pay taxes and bring those to the interview to prove he doesn't

for 2, getting money from the VA does not prove domicile at all. He needs a home to return to, an apartment lease, bank accounts in the USA, job to return to, drivers license, voters reg and voted etc.

If hes got no home or place for you guys to go to and no job to prove hes returning its going to be fairly hard to prove you intend to return to the USA. Those are the 2 big things they look for.

These requirements are different for every country , but we submitted proof of credit card and bank statements with a US address, current driver's license, place to live, car insurance coverage in the US, etc.

3/2/18  E-filed N-400 under 5 year rule

3/26/18 Biometrics

7/2019-12/2019 (Yes, 16- 21 months) Estimated time to interview MSP office.

thanks Inky,he has a daughter in the US though,maybe we could stay there for a week until we could find our own place to stay.

is a letter from her daughter could help stating that we will be staying with her?

arrghh..i am really worried..by the way he's already 79, i could not think anything else.

he cant go back to US without me for no one will help him for his needs.

How long has he been in the Philippines?

The valid drivers license is great. Might he still have a valid voter registration?

A letter from the daughter is a good idea; where do you plan to live long term though? Maybe signing on with a letting agency or realtor and starting to look for a property would help.

If he has furniture or other items in storage, show the bills for that.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

This is not as hard as many people think. The law says you have to show intent. Even if he is not required to pay taxes he could still file. If I were him I would write an affidavit stating that his intension is to return to the US to live siting his age , disability, the fact that he has a daughter, family, there and that he desires to spend his remaining years in his home country. Any other thing he does only helps, bank account, credit account, voters registration and so forth
