Previous k1 visa, no divorce, now CR-1- problem?

that i don't have any idea. but here in the philippines she never been married..and the ex hubby married couple months after she leave the states last 2007 tsk tsk...

by the way my friend got married to another USC last 2010.

Op stated the ex husband is also remarried? Either way she's gonna need a certified copy of that divorce decree won't she? Or annulment paperwork if that's what he did.

yeah re married same year she came back philippines and that was 2007. and my friend got married here in philippines last 2010

Either he got a divorce before he re-married, in which case see my option 1 (and if he re-married another Philippina and petitioned her, this is likely), or he is also a bigamist. Just because he re-married doesn't mean everything is ok, she must get the divorce cert to prove she was free to marry. Marriages are legal in most countries, even if you married in another country. Ie just because she married first time in the USA does not mean she was single in the Philippines. Married is married.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

i strongly suggest for your friend or her husband to find out if there was a divorce filed in las vegas for their marriage in 2007 or where his husband currently lives. Maybe ex husband will give her a hard time obtaining divorce papers. As what they advised, it can be grounds to lifetime ban in US. goodluck.

Use this link search for the marriage. This is where Vegas marriages are recorded.

If she is married she needs to NOT go to the interview and straighten this out. Claiming you aren't married there isn't going to work. She plans on being in the US soon and it sounds like she may be married here still and as soon as the government figures this out she will be deported and banned for life. If the ex got a quickie divorce/annulment she may be ok but she needs to document this. They will already know she had a K1, they will ask about that K1 during her interview, what was she planning on saying ?

This will not be over quickly. You will not enjoy this.

If you mean you just confirmed she is married then she is setting herself up for a ban. If she goes to the interview she has scheduled they will ask about the K1 and if they haven't looked already they can at/after the interview and discover what you just did. IF she didn't disclose the prior marriage in her application she is already on thin ice. Lying to immigration is never a good thing. Divorces are also usually public records. She/you need to look for that . Maybe in the area where her first husband lived .

This will not be over quickly. You will not enjoy this.

true. Its not yet too late. It might be confirmed she is married, but the divorce decree is separate. The wife should check with the state where the husband#1 lived maybe she can obtain a divorce decree. Or she can contact husband#1 to seek help.

Just because Clark County shows she is married does not mean a divorce was not issued in some other county/state. Find the divorce paperwork and amend the paperwork or have originals with them at interview and come clean there. I am sure it will go into AP but that is much better than a lifetime ban for trying to pretend it never happened.
