Csc lets all returned petitions expire. Vsc sometimes reaffirms. It may take 6-8 months to hear from uscis if you hear anything at all. Keep gathering proof that you are bona fide and refile a k1 or marry and file a cr1.

what is CSC and VSc? Should I be calling USCIS or just wait? when you say refile, are you talking about doing everything all over again and should i be doing this even before i hear anything from USCIS? Should i be sending more proof to USCIS or just gather it and wait?

For that period of time we didn't talk about the visa or think about it. After the 2 weeks were up we talked about what we should do. I could move to Pakistan or we could wait for a chance to appeal. We decided to wait for a chance to appeal. When the time came we won our appeal.

I'm telling you all this to say I understand you being sad and depressed but you and your fiance need to take some time off from visa stuff then come back and decide what you want to do. Don't rush into anything. Give it some time to see what happens with your petition. If you decide to go there and get married front-load your CR-1 petition with pictures, emails, chat logs, etc.

we had all our pictures, emails, skype history, even our engagement pictures. How long did it take you after your appeal and was successful? it has been 14 months since i first applied for it. just the idea of another 14 months is so depressing, but thx for ur support....

CSC is California Service Center and VSC is Vermont Service Center. One of those centers handled your K-1 petition when you first filed. The embassy will send your petition back to NVC which Y will send it back to the service center that first handled the case.

Your first phone calls should be to NVC to see if they have your case. They will tell you when it was received and sent back to CSC or VSC. Then you can start calling USCIS. You don't send anything to USCIS until you get a Notice of Intent to Revoke which is your chance to appeal the embassy decision. Then you would send your proof of relationship.

Most K-1 petitions are allowed to expire in which case you would either file another K-1 petition or get married and file a CR-1 petition. You would pay all the fees all over again as well as redo all the paperwork.

What is your service center ? California or Vermont ? Look on your NOA. WAC in your case number is California.

CSC stands for California Service Center, VSC is Vermont.

You can contact your senator or congressman a.s.a.p. to ask for a second chance for an interview which I am pretty sure won't be granted but you can try for a slim chance. Ask the senator to get the diplomatic pouch number your case is returned with so it will be easier to keep track of it should become "lost".

Your case will be floating around somewhere for a few months with either agency, NVC, DOS or USCIS telling you it is not in their system. It will take many months for UCSIS to tell you anything, even if you call them. You will get generic answers that get you nowhere.

You can't send in more proof now because there will be no NOIR letter to respond to if you are with CSC.

After 180 days sitting in storage your petition's validity will be purposely allowed to expire at CSC.You may or may not get a letter saying you are free to refile.

VSC is a bit quicker and once in a blue moon reaffirms a K1 petition or may send you a NOIR letter to which you must respond no matter if you have refiled by then or not.

CSC will NOT reaffirm. Appeals are for spousal visas which don't expire.

In your case a refiling or marrying and filing a CR1 are the best options. The CR1 will carry a bit more punch than refiling another K1.

You are more likely to overcome the "bona fide" issue with marrying and continuous proof of relationship. Even if you think they will not look at it, submit it anyway. All of it all over again when you file again.

Visit again. Submit proof of the visit, more photos etc.

If there is another reason for the refusal then you must find out and overcome that reason because the same hurdle will be there at the next interview no matter if you file another K1 or CR1.

Often they will not look at your evidence at the interview because their mind is already made up to refuse for some reason.

Frontload the next petition to USCIS (meaning send as much relationship proof as you can from the start, don't wait until the interview).

Lastly enter 'returned petitons' into the VJ search and read all the pinned threads that pop up.

Been there, done that, have the T-shirt. My drama is in my signature space. Our case was refused and then went into AP for 16 long months and after that it was returned.

It has been 6 months since my petition has been returned and absolutely nothing has happened. I was told by a smart aleck (tier 2) that our case will sit in storage for 180 days. There it will expire. On purpose. Then you can start over. I am sorry but these are the hard facts.

Actually once you hit 4 months after your K1 was approved you can assume expiration and file a new K1. This forces them to pull out the old K1 and take action ( either RFE the new one or NOID it is you didn't overcome the issue.)

I agree, you can start over sooner than the 180 days. On the repeat filing many have not received a NOID/NOIR letter though.

I guess that is because the assumed lack of bona fide was overcome with marriage and the new filing of the CR1 or they thought you must be for real going through this ####### of a K1 again. Who in their right mind would go through this all over again if it weren't for a true and genuine relationship. Many would run for the hills.

Actually the act of getting married does not prove a genuine relationship. Many scammers think this is true and want to run to the alter as soon as your plane unloads. Most second petitions are more carefully prepared and have to overcome the first rejection even if they are not the same visa type. Also there is a bigger burden on the embassy to PROVE a second rejection rather than rely on their suspecions.

The act alone does not, but going through hell for several years and spending a small fortune to be reunited usually does overcome the "convince me you mean it" attitude of the CO. They do set you up for that sometimes no matter how many times you visit or how many bags on rollers stuffed with evidence you roll in with.

Dont take it hard on your self or on him. People sitting in consulate does not understand our pain. As someone earlier said, take time off to cool down, and then try to contact your senator or congress man, explain your situation and try to push your case forward. I suggest you collect all evidence even small things matters, I am sure you have done that before but still go back re track everything. When you get a chance do post your interview experience so that people can help.

On April 23, 2013, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

then right after few minutes, i get another email.....

Contradicting notifications, you can call DOS in about 1-2 weeks and inquire if the petition has been received or if it is still in review with USCIS. If you don't get a decent answer have your senator inquire for you. Stay on top of your case.
