Hello everyone,

This is kind of an embarrassing topic, but I need to figure this out. I am married to an American, and I got married in Norway, my home country back in 2009. How is the rules about divorcing and such? We live in Texas, and I have a permanent residence card for 10 years. Will that affect my status? I really appreciate everything you guys will be able to help me with!

divorce after receiving a 10 year green card won't affect your immigration status as a Legal Permanent Resident.

The clock changes, however, for computing 'time served' as a LPR when chasing after USCitizenship, when you're divorced though - so bear that in mind.

many folk handle the divorce DIY - the instructions for 'how to do' are usually on the county web site (the county in which you reside)

Divorce DIY, meaning what? On a website it says: "We are not attorneys and are prohibited by law from giving any legal advice. We cannot give you instructions on filing your divorce or answer any questions on the accuracy of your papers or how to present your case to the judge. If you intend to represent yourself Apro se@, without the assistance of an attorney, you must have the knowledge to prepare and file the proper pleadings and present your case to the court. We advise you to consult an attorney if you have any questions or are unsure as to what you need to do."

So what do I do? Do I have to have a lawyer?

DIY means Do It Yourself. Like how VJ is set up with all the information so you can go through the process yourself.

There isn't one, I was using VJ as an example for you as to what DIY was.

Contact Legal Aid in your area. Some will offer free advice on what to do.

Okay, thanks everyone. I was also wondering, how do I change my name on my green card? :-/ Would that affect any of my status or will the immigration authorities ask a million questions about my divorce? I am worried about this.

Your divorce won't matter as you have a ten year green card. There's a pretty hefty fee to change the name on your green card, $450. You'll be filing an I-90 with reason (E) My name or other information has been legally changed.

As to how to divorce, every state has its own laws, and each county has its own procedures. You should be able to google DIY divorce Texas and find out if DIY is an option. No state or county allows its workers to give divorce advice. So just because the county worker or web site won't dish out the information, does not mean its not possible. You just need to research it in the correct places.

Hi. I have filled in the paper work and will file for the divorce soon, but I don't know if I can keep my name as it is, and then later on change it. How would I change it legally then? And would I have to change it in court again and then at the immigration office, I am very confused. It's very expensive! :( Thanks so much for your help!

Most states allow a name change with a divorce. Changing it on the green card takes a fairly hefty fee, $450 with the biometrics fee added in. You file an I-90 with option E.
