So let me get this straight if you have a ten year card how long do you have to get a new one?

If you have a 10-year green card, that means you are a regular (non-conditional) permanent resident. The permanent residency is permanent and you cannot lose it by not having or not renewing the green card. You can renew it at any later time if you want. (Of course, it is convenient to have a non-expired card, but not having one doesn't matter for the status.)

Not many people have their 10-year green cards expire because they would usually have applied for citizenship at that point (which you can do after 5 years of being a permanent resident).

So if he applies to be a citizen do they do a background check on him? Will he have to tell them why hes divorced? If its final by then and if hes married will they be able to find out?

Yes they do a background check. His domestic violence record won't look good for him.

No the reason for the divorce isn't relevant... unless isn't because of abuse then of course it matters.

Yes they will need to know about his relationship status.

Whether you are divorced or married at the time he files, if he's filing based on 5 years being an LPR then you are irrelevant (i.e. they won't want to talk to you, and your marriage won't matter).

if he lies and says he was never married... well that may affect him but it doesn't matter for you. They will know though, especially if you filed taxes while married, not to mention the Order of Protection they will see you listed as spouse... they will know but it won't affect you.

Why would he lie.

It is irrelevant.

I just wanted to know cause it would be karma for him is all cause of what he did to us...we did not file taxes together but i do have the order so maybe it will come up cause he thinks he can get away with anything

A Protective Order is not relevant for Naturalisation, why do you think he is now so keen to naturalise?
