It sounds like your husband has a Greencard (one that was good for 10 years). That means he is a Legal PERMANENT Resident. That means that even though his card expired, he is still a Legal PERMANENT Resident. His card expiring is not a big deal. He can just get a new one.

If he got his Greencard through his marriage to you, just in the last few years, then that would be different.

Even tho it has been exspired for more than a year and its good for 13 years i found out it exspired sometime in 2011

If he beats you, there is a 99% chance he will beat your child. So that's your deal. There aren't remedies for him unless he has another qualifying relative. If he has an employee to sponsor him he can only be out of status for 180 days, not more under Section 245k. I don't think you are gonna get a lot of child support from an abusive spouse. Having been divorced from one myself, believe me I speak from experience - the longer you and your child are attached to him, the longer you will both suffer.

This post screams crazy.... If you're talking to a lawyer already they can advise you. If he's over staying and there's an order of protection and he breaks that he could technically be deported. So having the order of protection, but yet wanting him to stay around doesn't make a whole lot of sense. I kind of have a feeling that might be the norm for you.

We have a child together other than that i could care less i just wanna know what kind of trouble his dumb #### done got himself into so i can prepare for me and my child is all its not the norm believe me ...also he has let his green card lapse which i believe now is only a 2 year one by more than 365 days so i just wanted to know if we went to divorce child support would they find that out

also i just found this out about his status like a week ago after i had already put the protective order on him which in the state where i stay i had to because we are married he could come home at anytime and just be there since we are married ....post screaming crazy no cause i ws legally covering myself in the event of a divorce i did not know then the fool let his status lapse

Ohhh ok i found out he had a 10 year card then when it exspired he had a 2 year green card idk what thats for so the 2 year one has been lapsed for a year i had to dig more

Immigrationand you your child and support are different items, have your divorce attorney get on it if he/she is not. If he leaves the country you will probably not see a dime. At this point you have no control on his immigration.

Believe me everyone as im finding out new stuff im posting thats why there is a slight delay but thats what im trying to figure out cause i feel he may have just forged his documents cause when we got into it he went to his mothers and when she found out i had a protective order she kicked him out and i know that his family is all not from the usa so idk if they wanted the heat on them
