Hello guys, a few days ago I receive an email from the NVC, with the "infamous" checklist. No, it is not a false one.

There´s some mistake in both AOS forms (my wife and our joint sponsor).

-My wife´s checklist is an easy one; we wrote on the I-864 that she had an income, but it is from Spain (we´re living abroad). So, I understand she has to mark Unemployed and 0,00 $ as here income.

The tricky part comes with my mother-in-law checklist, the joint sponsor.

The checklist says:

General Instructions

[x] You will need to complete and submit the new form completely filled out (all pages required), which includes

the changes noted below. Submitting single pages of the form with the correction is not acceptable. In order

to make corrections you will need to download a new form at www.ImmigrantVisas.state.gov.

Part 6 Sponsor's Income and Employment

[x] This part has not been appropriately completed

[x] _____(JOINT SPONSOR)_________________________'s income entered in line 24a does not equal the income entered

in line 23.

[x] The amount entered in the Total Household Income line does not equal the sum of the amounts entered in the

preceding lines.

[x] ________(JOINT SPONSOR)________________________'s income indicated on the I-864 Part 25 does not correspond to

the amount shown on the most recent Federal tax return and W-2's.

Ok, first of all: The joint sponsor´s income in 24a, it is the same than in q23 and in the total Household size. It is true that the income differs in I-864 part 25 from the most recent federal tax return.

On the join sponsor´s W2, the income appears as a single person. It is the same amount that it is on the I-864.

The tax return, howhever, there´s a bigger income, because the joint sponsor filed with her husband.

So, on the q24 b (Income you are using from any other person who was counted on the household size) we did not count the joint sponsor´s husband income, just the joint sponsor.

The big question is... What INCOME should we type on the I-864 form?

Please good people from VJ, we´re almost there and we´re kind of freaking out, we would highly appreciate some help on this!

Ok, I just spoke with 2 NVC representatives, and explaining the situation, we realized that in the 23 and 24 questions, we put the income that figures on the joint sponsor´s W2. They said that we must write an estimated income of what she´s gonna make on this year, so that is the reason on the checklist. On q25, where you put the 3 most recent tax years income, we should wrote the W2´s income.

So what did you put for question 25?

Yes, for the other questions about her income, you estimate current yearly income based on what she is currently being paid. That should correlate to any employer letters or pay stubs that you have submitted.

We put the amount that appears in the IRS tax return transcripts, that she and her husband filed together. A NVC representative told me to put the W2´s amount instead of the other ones.

We just got the same type of checklist.

It's the same problem as you since our co-sponsor filed a joint tax return but is only using his income to qualify. We wrote the W2's amount on part 25 and we got a checklist. We called the NVC and they told us to write the amount written on the tax return instead, which is the total opposite than what they told you since you got a checklist for that too... This whole thing is not clear at all.
I think this is just crazy. I don't know what to do.
Finally, your case has been approved using which amount for part 25 ? The one of the W2 or the one of the tax return ?
