My husband and I were married from 2008-2011. I sponsored him to the US and we moved in December of 2010 to the US. We split up in March 2011 (doctors said I wouldnt be able to have kids and that was a deal breaker for him). Anyway, I moved back to Canada in November 2011. He moved back to Canada in March 2012 and has thus been out of the country for over a year. He has the ten year PR card. I am trying to figure out how he prove he abandoned his status. He however, plans to move with his new GF back to the US on the green card that I sponsored. He is going to have some of his US friends make up a false lease to prove he "didnt intend to stay gone and maintained a US residence" which he obviously didnt. I dont care what he does but I dont want to be responsible for him. How can I go about canceling my sponsorship of him/ prove he is trying to commit fraud about his leaving? Thanks

You cannot "cancel" your I-864 affidavit of support after the green card is issued.

If he didn't obtain a re-entry permit before he left then once he has been out of the US for a calendar year he won't be able to re-enter on his green card anyway.

If its after a yr he has'nt abandoned gc. if he is doctoring papers, Y he's been gone for a yr,fake lease , new GF,

you have to have good evidence of fraud marriage, because he is coming with doctors proof U cant have kids (so

that prove good faith, lots of consummation) Some ppl male & female cant deal with the fact of never having their

own kids, I know it must have been a blow , but to me it seemed he had a real wife from U but just wouldn't stay

without having kids....uscis may think that U are bitter...I wish U well, try to move on

since you know of his intent, i strongly suggest you write a letter detailing it, send to all USA CBP offices at the Canadien border, and another one to ICE in the city that he's planning to move to. You probably have copies of his green card, include that in all correspondence.

Most likely, this won't cancel your sponsership, but if he doesn't get back to the USA within 365 days of his last departure date, is quite possible he'll lose his PR status, and your sponsership won't matter anymore.

He'll probably apply for citizenship to sponser his new girl. I dont think you'll be responsible for him once he becomes a citizens. If you have proof of his fraudulent intentions, them you should probably report it

Sorry about the not being able to have a baby part. A doctor can tell you one thing but God knows otherwise.

The commitment you made when you signed the I-864 will cease after 10 years or when the LPR becomes a US citizen, whichever comes first.

You can't cancel it.

..or when the green card is no longer usable. Example - stay out of USA for a year or more? Greencard is invalidated, pops up at POE, Foreigner usually is turned away and the green card is confiscated.

The options would be for him to surrender the card or go in front of an IJ if the POE make a fuss about it.

POE can not take it away.

You can not cancel it, but it can go on indefinitely, well until someone dies.

It doesn't cease after 10 years. You may be referring to having worked for 40 quarters for the purposes of social security. But if he doesn't work, he will not collect any quarters.
