Previous J1 HRR now F1

Hello!

I hope you're case was successful and you and your wife are already in the States and happy!

I wanted to ask for your help. I'm in a similar situation as yours at the time, and I hope you could help me.

Could you please share what happened to your case? I had a J1 Visa with 2 years HRR and once I graduated I went back home, but for only 5 months. After that, I returned to the USA on F-1 Visa.

Now I'm on my 60 days grace period and panning on marry my fiancé next week. We would like to fill out I-130 and I-485 but afraid that it's going to be denied based on my previous J1 status (I still have 17 months to fulfill).

What would you advise me? How was your situation solved? ...Should I go back to my country and not overstay after the 60 days end while waiting for I-130/I-485 to be approved/denied?

Please let me know, it is really urgent for us now.

Um, yes of course you are going to be denied. Flat-out denied. There is no need to "be afraid" about it because that is what is going to happen. You are ineligible to become an immigrant at this time. Either go home or chase an HRR waiver, BEFORE you file anything.

Um, yes of course you are going to be denied. Flat-out denied. There is no need to "be afraid" about it because that is what is going to happen. You are ineligible to become an immigrant at this time. Either go home or chase an HRR waiver, BEFORE you file anything.

Thank you for your respond! I really want to do the right thing. Me and my fiancé will be marrying and after the wedding there'll be just couple of weeks before my 60 days grace period ends. It seems that I definitely have to go back to my country. But I also read that filling out a J1 waiver is not much recommended if you're outside of the USA. I also don't know how this would affect my future to come back to the USA if the waiver is denied.
