I have been living abroad with my wife for 6 years. She had a green card, but we let it fall out of status since it would have been cost prohibitive to maintain it during our travels. I have just finished a contract with a local employer in Asia, but now, it looks like I have to have income (i.e. a job) in the States in order to move back. We have a young child, who is an American citizen, but the problem is...we cannot stay in Asia, and I don't want to separate my son from his mother, but I don't have a job to go back to, so I'm concerned that no job/income = no visa for my wife. We've got about $100,000 in cash and she has another $60,000 in stocks. I'm wondering whether that would be enough, or is it pretty much mandatory that I have a job first?

do a job first and pay taxes then you can sponsor your son...The income you are telling is enough but AOS consider on annual income base....NOT current bank balance and stock but this balance can help you if u have a job and you earn low salary.

This is completely wrong. First of all, the son is a US citizen so needs to visa. Secondly, assets are considered (though many US embassies want to see them be US based, so a US ban account etc), three times as much as income is needed, and the OP has that and then some.

OP: why can't you stay in Asia? The reason I ask is because it will take most of a year for your wife to get a new IR-1 spousal visa....

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
