How long for I-485 (Green Card) Adjustment

I applied for my I-485 back Sept 2012. My applications with fee has been accepted. I periodically check the USCIS.gov site to check the status. My wife biometrics were done in Oct 2012. What is the next stage toward getting the green card and usually how long does is take to get one. If eventually approved, are all green cards 5 years or 10 years?

It seems to vary on how long AOS takes. It depends on if your case is transferred to a local office or if it's stuck at the National Benefits Center. A lot of people seem to get interviews rather quickly if their case ends up being processed at a local office, but the ones that are being processed at the MSC are taking a long time. If you're processed at MSC, you might not need an interview, though.

Your green card will be for 2 years once you get it, and near the end of that two years, you'll have to apply to remove conditions.

If your case is at the NBC (msc receipt number) is taking between 7 to 9 month...I turned 8 month last week but at least I will not have my interview

All AOS cases have a MSC number, because they all go through NBC (new name of MSC). Because it's been a long time, your case will probably stay there and be waived from an interview (but you will wait a long time). Cases that are scheduled for an interview are transferred from NBC to a local USCIS office pretty fast after the biometrics.

AOS cases have not been transferred to CSC anymore since August 1st, 2012.

We're lucky enough to get approved in 62 days with interview recently but seems like people who didn't have interviews are having to wait at least 6 months

I am still alittle confused on the timeframe. I brought my wife here on a K1 visa. We married in July 2012 and filed for Adjustment of Status in August 2012. Is the adjust of status process different for K1 visas versus someone here on an IR-1? Do we have to wait for as long as 2 years and because of the concern of visa fraud with marriage type visas will we have to goto an interview? Right now our application is in acceptance status.

Yes, K1 AOS is different that IR-1. K1 AOS applications are sent to NBC (national benefits center) where one of 2 things will happen. It will either be sent to your local field office and you will receive an interview - this usually happens within a month or two of doing your biometrics, your green card is then approved at the interview OR.... the application remains at NBC to be processed without an interview in which case, you won't hear anything for a very long time - right now it is taking 9 months or more. They are currently working on July 2012 applications. How they determine which applications are sent for interview and which ones stay, no one knows for sure. Since you filed in August it seems likely you will not have an interview and hopefully you will get your approval soon - in the next month. I think everyone who has a petition at NBC is stuck in acceptance status - that is nothing to worry about.

Yep, we had our interview appointment letter a couple of weeks after Biometrics. It's a toss up, you either get through the process fast with an interview, or slow without. I guess I'm glad we had the chance to get it done sooner, even though we had an interview. It turned out to be nothing to be afraid of at all, although it certainly caused stress. But I'm mostly glad because it means my wife will ultimately be able to apply for citizenship that much sooner.

But if yours is going the 'no interview' route, then yeah it seems like 9 months even up to a year is common. The only good thing is that you should at some point just get a letter saying your GC is in production.

I was reading that there are some people that don't get interview because their case was moved to California office. If that occurs what kind of Green Card will she recieve and are the limitations? Since marriage visa are the quickest route to permanment residency in the USA. Don't we have to prove to the govermnent at some point that we entered this marriage under good faith?

It can take up to a year, if you have not heard about an interview within 3 months after biometrics. Regardless of when you receive the GC, it will still only be a 2 year GC, and you will have to apply for ROC after 18 months in order to receive the 10 year GC.
