here’s my story I am 27 years old now Born on 1985 living in the Philippines in Angeles City. my father is American and my mom is filipina (deceased) my father left a year after my birth but he did signed my birth certificate. 20 years later i found him through the help of internet and since then we were exchanging email and have been helping me financially now we have decided to apply for derivative claim to us citizenship. last week I have receive his birth certificate and military records. but I really can’t understand the legitimation process there were 2 methods to apply on different year of birth and on which method my case fall. I really want an insight about it at least enlighten me a little I can’t afford to hire an immigration lawyer.

The legitimation part to claim US citizenship is no longer an option.

However, if you have date-stamped proof like letters, emails, pictures and money remittance slips that a father-son relationship was established BEFORE your 21st birthday, then your father can file a petition for you.

If you are the... BIOLOGICAL FATHER, You must also submit:

* A copy of your child’s birth certificate issued by civil authorities

* If you never married the child’s mother before the child turned 18:

If your child is not legitimated under the law, you must submit evidence that you established a bona fide father-child relationship prior to the child turning 21 or marrying. This should be evidence of emotional and/or financial involvement in the child’s life.

You will be under the F1 or F3 category depending on your marital status now:

(F1) Unmarried Sons and Daughters of U.S. Citizens, waiting time is 14 YEARS. You must remain unmarried during the entire process of this category.

(F3) Married Sons and Daughters of U.S. Citizens, waiting time is 21 YEARS.

you mean to say derivative claim for adult is not available anymore?

It's no longer an option for you since you were not legitimated before you turned 18 or 21.

Your parents were never married right?

Are you the original poster under a different name? If so can you explain for future readers asking the same question  how you got citizenship... coming back just to tell someone 8 years later that they were wrong is not really useful to other posters if you don’t explain why...

Yes I am the original poster. The point here is not giving out false information especially if you are not sure about it. I am a 35 years old illigitimate son of an american citizen and I was able to get my US citizenship. I was born out of wedlock. But was able to be legitimated thru a state that legitimize child born out of wedlock.

Well, can you explain how you went about it for the benefit of others? Did it take you the full 8 years since you first posted? Did you use a lawyer? Does your parent live in Wyoming and if not how could you do it there? Etc

My timeline was from October 2020 to January 2021. I didnt apply for it till last year because of all the negative feedback I have read. I did not use a lawyer. My father had a domicile in Wyoming thats why. I am not sure what other state that have the same law. Its really better to go ahead and do the application don’t listen to others who really don’t don’t know about citizenship. This is applicable to us citizen kid over 18 years old born before 1986 and acknowledge since birth ie signed birth certificate.
