By Law USCIS HAS 120 days To Make decision from date of exam, then it's time to discuss whether taking your naturalization case to Federal Court through a lawsuit , but now is 8 months and u file divorce i think is to late just do what do lawyer told u and replay when u have 5 years you will be fine.

To the OP... it's not a bad idea that you contacted a lawyer (but feel free to get a second opinion) but I would also take Vanessa%Tony's advice. Call your congress person. If you had been approved within the processing time, you would not be facing this dilemma now. Good luck.

myafi, the OP Is asking for advice, not judgement. He's asking advice on the right thing to do - nothing wrong with that at all.

I think you didnt read my post carefully, I didn't judge him, and I gave him an honest advice " on the right thing to do"... but when I ended my post I wanted to bring to his attention that he shouldn't over stress about it in case of denial.

Have you contacted your congress person? You should have been approved/denied by now, this is WAY outside processing times. You fit the requirements at the time of interview and indeed months later... so I wouldn't withdraw just yet.

If you are divorced, you eligible to get your Green Card after 5 years of residence so at best they can deny you now. If at the time you applied for the benefit you were living and married to your spouse then you were eligible for the three year requirement. I would infopass it first at your local USCIS office. You can schedule the infopass on the website. They will blow you off at the front counter, so ask to speak to a supervisor and explain to him/her that your citizenship application is pending outside the normal processing times and you need to make an inquiry. They have been known to help then.

your next step is contacting the USCIS Ombudsman through their website because they can help when you are outside the processing times. Lastly, you can write your Congressperson regarding the situation. I don't see that you need to provide any information regarding your application when you ask. You are simply asking for status.

Worse comes to worse, you can reapply 90 days before the expiration of the 5 year period. It could have been lost through the cracks (not the first time, believe you me) or it could be a more complicated Natz application if you have some answers that you checked off as yes regarding criminal history (or perhaps their background check on you came up with some stuff if you have a similarly named person, or a fellow Moroccan with a similar name is on a no-fly list or a person of interest for our intelligence services - this has been a big issue for men under 35 who are nationals of Middle Eastern countries or Muslim nations in South and Southeast Asia), or you checked off any of the political activities questions and other matters relating to moral turpitude, willingness to serve this country, etc.

I'm not divorced yet, I filed for a divorce, the papers are not in court yet, they need my sign and her sign, but she's having trouble filling her papers lol, so. A lawyer told me yesterday the same, if at the time of my interview (8 month ago) I was married and still living with my wife, and "that was true", he said I can have a chance. I've been thinking about to make an infopass app, and do what you just told me.

I'm not worry about my own background, or something relative to that, my name is not very comun in my country, so everytime I got my name check from the biometrics, they got the results in 24 hours I don't have even transit tickets.

I have many options to do, thanks to you guys and your ideas, I really appreciate that. I honestly thought to withdraw my application right away because I'm getting a divorce, but I can have a chance because on my interview I was married and living with my wife.

For citizenship, just dealing with one IO, then that supervisor that may either be checking you or the performance of that IO. This doesn't make any difference, if either is at fault, you still pay the price. In rare circumstances, the office manager may get involved.

In the event of problems, sure helps to have a senator that is head of the USCIS finance committee, then you find these three people really trying to protect their jobs. Even with a special oath ceremony that is completely against their policy, like a crowd of some 3,000 people.

If their ever was stress in our marriage, was primarily due to the USCIS, didn't know if we could spend the rest of our lives together here, even tempted to leave this country at times. Two of my wife's friend from her home country ended up in divorce after citizenship, can only wonder if their marriage was stressed out by the USCIS. For both of them, was nothing here for them, so they both returned back to their home countries to be with their families.

When I was discharged from serving my country, just gave me a small check and told me to find my way home. Was no counseling afterwards, see they are doing that now. Feel the USCIS should do the same thing after all the stress they put us through. Took us months to stop gathering evidence to prove we were living together. Instead of saying the most important part of getting US citizenship if the right to vote, should say getting free of the USCIS.

Both of my wife's friends could only find minimum wage jobs, least after getting their US citizenship, could apply for food stamps so they could eat, but guess that wasn't enough for them.
