Im freaking out right now!!! My girl was here on a j1 visa as a nanny. I just read something about another persons thread and saw this link. Is this saying she has to stay in her country for at least 2 years before she can even come back to the USA?! She left last june to brazil and we filed in august .. Im so worried now what does this all mean? I dont understand though, one of our freinds did the same thing as us. HE was us citizen she was brazlian and was here on her J1 visa, she got denied her student visa so they filed for k1. They were approved in about 6 months. please explain. Thankyou!!

please review the visa stamps in her passport, any home residency restriction will have a special coding in the visa stamp.

Once you see the visa stamp, please tell us what's coded there?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thankyou jesus! Ok so it says visa R j1 and on her visa stamps it says, is not subject to section 212 E two year rule does not apply

Thats a good thing right?! Ok BUT she extended her stay LEGALLY for another year. It was a 12 month program, then of course met me and stayed another year ;] Is that a problem? I still have not heard from them yet about my RFE but they recieved it march 5th i hope any dya now i will be approved. Also IF this was a problem, woulnt it come up in the RFE?

so if she's not subject to it, cause the stamp in the visa says so,

IMO, she's golden - no waiver required.

re: a 2 year wait - this is normally addressed at the IV Unit, on interview day, so is rare for any official notice of it prior to interview day.
